Default Speeding ticket advice...

Just got back from being away for a week and received a speeding ticket through the post, thing is, the letter is dated 5/4/07 and the said offence (38 in a 30) was commited on 3/12/06 Surely they cant expect me to remember who was driving 4 months ago!

The only sense i can make of it is that i bought the car around that time so i dug out the log book and actually found out it was the exact day of the offence 3/12/06
Im not saying that it wasn't me driving, it may well have been, but i definately do not remember being flashed at any time.

The letter asks if i was the driver at said time and date but only gives the options yes or no, i need a "dont know" option

Where do i stand with this? Anyone been in a similar position?

Dunno what to put tbh.....

Well AFAIK they only have 6 months to do you for it anyway, and you're already 4 in, so it surely won't be that difficult to drag it out a couple of months!!

I would check on that one mate.I always thought they only had 3 months to get you.Its different for fixed cameras and camera vans but the max time is 3 months.almost sure of it.good luck though.

Did you receive a NIP(Notice of intended prosecution)within 14 days of the alleged offence..?

If not go and see a brief,they have to send you a NIP straight away,if not you can probably get it binned ....

it will state what time the offense happened, write a letter saying you bought the car some hours after!

plus they only have 14 days from date of offense to issue the NIP

so wipe your arse with it lol

Probably in this case.... they sent it to the previous owner first and he has delayed and faffed about, then denied it was him. In cases like this, the time limit is 6 months. It's gonna be a case of your word against the previous owners.

The first NIP has to be issued to the registered Keeper within 14 days, but there is no prescribed time-limit for second and subsequent issues. If the original owner took all 28 days (which does the real culprit a big favour, towards hitting the 6 month time-out) then replies saying he sold the car to a dealer, the cops issue a new NIP to them. They then return it and the cops send you this one.

But you have 28 days to return the NIP - hang out to the very end and you are over five months into the 6 month cut-off , then write back saying you have checked your diary, learned this is the day you bought the car and have no recollection of having sped at all - then ask for pics to aid in identifying who was driving at the time (you don't really want these, but it is just to stall the thing for another 2-3 weeks.) I'd say you will be very unlucky to get done on this.

Don't just ignore it though, because there is an extra 28 days (I think) for the separate offence under S172 of failing to provide info and that carries a much bigger penalty including jail-time - but no points though!
