Been to police station, receptionist was on the phone so we sat down..she then came off the phone and sat there for 20 minutes before us standing up and her going ''Hello, how can I help'' like some sort of bloody time warp Bless her though she was very helpful when she realised we hadn't just come to the police station for a sit down at midday on a sunday
Long story short..they managed to get in contact with him and I managed to get an address and an actual name from this to give to the insurance company (as earlier I only had the phone number and a random name)..so we'll see how it goes ...the bloke actually remembered he was there which is a help I'm sure you'll agree

hey kate get to the hospital about your injury,you can claim compensation,but you need to go to the hospital i know its time consuming but trust me its worth it ul get roughly about Ł2000.my mates have done it a few times

As I said to Toe Knee earlier on Msn fezzanut..if I'm hurt..I'll claim..
At the moment I think I'm just aching like fook & pretty bruised/shaken...which isn't neccessarily a long term problem...
If I'm still in pain on Tuesday I'll get checked over by my GP/A&E as applicable.

My car however, is fooked. When/if the guy admits liability I'll be requesting a courtesy car, to allow me to not be disadvantaged due to the crash..I'm not into making up a fake injury to get Ł2000...compensation is to compensate you.... I'll only want some money for an injury if it prevents me from doing something..ie walking, going to Uni..not if I just think that twat drove into me so I'd like a cheque please. If only because I couldn't live with myself exaggerating when compensation is designed for people who are at a health 'loss' due to an accident.

I'd rather just get my car sorted & try to blag a bit extra for my inconvenience..in the form of a courtesy car so I don't have to fund an alternative whilst it's getting fixed.

Took me 4yrs 2 get mine finally settled this year, and ive still got problems with my neck from it. So now have to live it with and hope i dont have to take more time off later on again cos of it or what i got was peanuts!!

Thought I'd update instead of making a new thread..more than anything else it gives you an idea of how long this is taking..

He told my solicitor he was faxing her his details all last week...and didn't ...turns out he gave me a fake name, she had to trace him and can't find any insurance anywhere...which my dad has also checked as he works in insurance claims...basically...the vehicle isn't insured by anyone..but is owned by said guy...who used his middle name as his last name to me (yeh, you're forgiven if you're lost by that)

Anyway,...2 choices now, going straight through the MIB who'll take the first Ł300...

or take the bastard to court...which will probably result in me waiting longer for any damages, if at all...but if I go through MIB..he doesn't pay me fook all

Have to ring solicitor tomorrow to issue court proceedings...to be honest it's got to the stage now I don't care about the car being repaired any time soon...I've been waiting over 2 months...forgotton what it's like to be able to drive now as I hardly have...
I can't have it at Uni as I can't get a parking permit as all spaces have been allocated...so I just want to let it go through court...I've been so fucked about by someone who is quite obviously driving around without insurance...so I'd very much like to be able to air that point...

That sucks, sorry to hear and uni parking, been there with an all too similar situation but not from accident damage but from being out of the country and having my dad do it.

Lol...as Gareth said, not all that useful...but thank you anyway...

Thing is, had he sorted it then, it'd have been damage to car (Ł1350)...since 26th August it's been that + Ł10 a day loss of use...+ telephone/postage costs + solicitor costs he'll have to pay....damage + loss of use is over 2 grand my solicitor said...omitting the rest...and will continue to grow until the car is repaired (obviously)...

Only problem is if he gets a damages award against him...he won't have the cash sat around to pay me so will probably get away with Ł5/week...we shall see eh.

At least it's a civil case so will go to small claims court so I'll get a Judge as opposed to a magistrate...so at least I can call it work experience

Katie i went through the M.I.B (same sort of case as you) with one of my old car's and it took fuckin AGEEEEEEEESSSSSSSS all in all about two year's to be paid out. i was claiming for injury to though so it made it worth claiming in the end as i ended up with just over 3k so if you go the M.I.B way it might take even longer to get sorted

I can see why people might fake it though...you can't file a police report for a driver you have details of (if you aren't at that point aware he's uninsured..ie like I got an address from the lady at the police station and was quite happy with that) unless you are injured, or he sped off (he would have if I didn't get out of the car first, but the detail is irrelevant). So by my thinking the best of people and looking for his insurance first..before accusing him..I couldn't file a report on it...

So the only way people can fast track their case is to have an injury...it's a really nasty setup when people wish they had a small injury so they wouldn't have to waste so much time and energy getting nowhere...

Sometimes I do question the point of my honesty...had I been a liar and complained that the shunt did more than just the sort of aches and pains you'd expect from a car hitting you at quite a speed (in reverse) when yours has its handbrake on (that went within a week) then I'd have been through and out by now and could have just donated the injury money to some charity or other...

the laws in this country a pathettic the poice, should get round there arrest the twat for no insurance, make him pay you costs, then send him to court once hes paid, and then fine the cunt say 5 X the insurance cost, when he pleads he has no money and a family to feed, tell him tough luck, you need insurace to drive, so you should have been driving and the person you hit allso has family and to pay out for the damage. jail him, bet the money soon apperas

He can say what he likes...I know exactly what happened, down to every minute detail....if he wants to play silly buggers, he can...but I very much doubt he'll keep going to the sort of timescale I am able to...my dad's also been telling me every single possibility of how he'll try and wriggle out of it...(works in insurance claims...been doing it 20 years)...things such as not turning up to court because his kids pet died, claiming lapse of memory, claiming I drove into him, excusing himself by complaining of a neck problem that meant he couldn't look behind to see if the other car was there (yes, somebody actually tried that!)

As much as he wants to lie..game on mate...whatever he says I'll have an answer for as I won't actually be lying...he's the one who'll have to cover what I've said with crap...not the other way around...

Update...yes...8 months on...it continues...

Right...so all my forms went off to the motor insurance bureau for the uninsured drivers claim...the police gave him a producer...and on the last day...he produced....a Tescos insurance certificate?!

Just had it confirmed by tesco's through my solicitor today...he's insured by my insurer...they didn't list him on the MID...they didn't check their own databases to see if he was one of theirs...bahh!

Anyway...predictably...he's now disputing liability! Lovely!

Dad said to send tescos a letter saying if I don't get a settlement figure or percentage detail (ie..them telling me I'm getting 100% not 50:50) within 21 days I'll be starting small claims proceedings...tbh...by then it'll be 9 months...and enough really is enough

I hope he loses his NCB anyway and understands how fucking awkward it is to try and claw back!
