got done riding in bus lane on a moped - UPDATE
Some of you might remember I got 2 letters through my door back in April charging me with a fixed penalty notice for contravening a bus lane on 2 seperate occasions on my 50cc moped.
well, despite the mockery (about riding a moped ), and the negative replies I got about getting away with it I decided to persue my case. (I was arguing that my moped is taxed as a bicycle and the bus lane signs indicate that a bicycle is permitted to use the bus lane).
My initial appeals to the council were rejected and the final stage is where both my self and the council ("the authority") have to represent our cases and evidence to an independant tribunal.
I got a letter today saying that the authority are no longer going to contest my appeal and all penaltys have been dropped!
Thats just got me out of £200 worth of fines!

The taxation class for my moped is Bicycle. It says it on the log book and the tax disc - I think most bikes including motorbikes are infact taxed as a bicycle - strange but true!

I think what he's saying is that he pays tax, but the vehicle's classification is bicycle. Therefore he is contesting the fines on the basis that his vehicle is classed as a bicycle by the relevant authorities, and because bicycles are allowed in bus lanes, he isn't breaking any laws.

Ok bascially I ride moped. Which in terms of road tax is classed as a bicycle.
The letter I got from the council stated that the bus lane is for use by buses, taxes and bicycles.
So I had them on a technicality.
When I pointed that out to them they then said they mean push bikes not motorised ones.
So I checked the sign in the highway code and it just refers to bikes as "pedal cycles" - no mention of push bikes or not including certain types of "bicycle". So I argued that as Im riding a moped, technically I could have been pedaling!
Overall my argument was that the sign does not technically indicate that my bike is excluded from use of the bus lane.

lol no its a scooter, but here's what the DVLA say:
Moped
A moped is a motorcycle which:
cannot go faster than 50km/h
must not have an engine over 50cc
can be moved by pedals, if the moped was used before 1 August 1977.
So even though mine doesnt have pedals, its in a class of vehicle which can be propelled by pedals!

Re-reading it i think you were lucky. It says mopeds with pedals registered BEFORE 1st aug 1977. As your moped was most likely reg after 1977 it wouldnt have been included as a bicycle but as a motorbike.

yes you are right, but my point was my bike is in this catagory of motorbike.
Basically they couldnt clearly define what the picture of a bicycle meant.
