Default 3 points for nothing!!!!

Can anyone give me any advice? Ive just been given 3 points for supposedly overtaking on a solid white line. Where he accused me of doing it there is no solid white line (as I went back and checked). The copper was on his own on a bike and I had a passenger in my car as a witness. Is there any point in trying to get it dropped?

Some plod are lying bastards but the courts will always take their profesional opinion over small details like facts. In all honesty I would say you have no chance

A few people on here will be able to tell you all about police lying through their teeth

Maybe take a picture of the road where they say you had done it and send an attaching letter contesting the fine ??

Another thing he has done is put the wrong date on the penalty notice and on the date he has put I was in work.

Agreed, the magistrate will usually just accept the coppers testimony

As mentioned above, pepipoo would be a good place to ask though

Definately ask on Pepipoo about that, theres a good chance you could kill that at source with a well written letter imo

Did the bike have video?

Wrong date on fixed penalty doesn't matter, wrong date of offence when presented to court does matter. He's unlikely to get it wrong there.

There was no camera on the bike. He also said my car wasnt mine and that I had stolen it because he had misheard over the radio.

Try this website......

www.5ive-o.org

Its a site where magistrates and police go on to share their knowlege of the Law to us lesser mortals. If you post what has happened I'm sure that someone will tell you what to do either way

how can they honestly give you a ticket if there is no white lines, would contest to be honest if your sure there is no white lines, go and record the lenght of the road on camera. Why didn't you denie it to the police office, what did he say?

I did say that I didnt cross any white lines and all he said was take it to court if you dont like my decision and then he said who do you think the court will believe. There was white lines on the road but not where I overtook.

hopefully at some point the term "professional" will stop being applied to the police, as 99% of the fuckers are NOT very professional IME!

The law (just like most things in modern life) is run like a business now so..
Magistrates courts are not geared toward motorists pleading not guilty(too
expensive given the potential small return/£200 or so fine)Requesting a hearing forcing a P.C. to attend will usually kill it DEAD/if not take photos,
get independant (an AA man will do)testimony that the Officer 'must have been' mistaken.
NEVER accuse a serving officer of LYING in what used to be called a Police
court(for obvious resons).Adhere to the above and you should be OK.
ALWAYS REMEMBER THE OLD LAGS RULE NEVER ADMIT TO ANYTHING.
