"witness statement" - 11 months after the accident
Some of you may remember the bike accident I had nearly a year ago...
Well I've just had a witness statement turn up from the drivers insurance company saying I was doing (in his opinion) 45mph, saying he didn't actually see the accident happen and that he wouldn't be prepared to go to court...
Now this seems very strange to me that a witness comes forward when I've had a settlement for the bike (without admission of guilt though) when I'm now claiming for the damage to my bike gear.
Anyone got any experience of this kind of thing happening? I'm just worried that there is a tiny chance I could get shafted on this one

I've just done some homework and found out where he lives, across the road from her...
Cheers for the replies, its what I thought really, just seems strange she's "found" this bloke after 11 months when I'm trying to squeeze some cash out of her for the bike kit...
he says in the statement "I saw him travelling at 45mph and thought 'where are the police when you need them' "
Oh you good samaritan
I only had bruises afterwards too, think I might have done some more damage at 45, especially with my head and helmet being wedged under a car

Impressive as bike speeds are so hard to judge... hence all the accidents
Get them in court, if they're down as a witness for their insurance company then they have to go to court. If not their statement means fook all. Just trying to scare you. When you got the money from your bike what was the split your insurance company agreed with?
