car dealer fraud???? police now involved
I need some advice on car dealers regarding log books.
I went a renault dealer to have a look at a clio 172 cup on a 53 plate When i got there the car was not as mint as i was expecting! so i basicly told the salesman he can keep the car, and i drove home at this point i was very p!ssed off i had drove a 4hr round trip to see it
The tyres were slicks with no tread the brakes were completely shot!! and to top it all off he said it had just sailed through an mot!!
anyway yesterday i got the full logbook through the door!! for the clio cup
I thought i would have had to fill out my details on the old logbook and sign it for me to get a new logbook in my name!??
am i right in saying they have forged my signature??? and what can i do about it?? personally i want to sue there arses for f%cking me about!!!

Don't go bribing (sp) anyone mate if you plan on taking legal action against them ffs!
You at the moment are in the right with them in the wrong, two wrong's dan't make a right mate
I'd speak with a solicitor or someone in the know (properly, not down the local ) and see what sort of a case you have! HTH

something don't add up but why forge my signature??? maybe the sales bloke was a bit hasty and thought he had a sure deal before i looked at the car!

well, basically now that car is yours mate, i would go into the garage and ask them politely that you have received the paperwork now wheres the car? And if they say they have made a terrible mistake then go to see your solicitor after that take the person name who admitted it or was looking into it, and say they must have forged your signature, as thats really not on!
sounds like well a dodgy garage
If it was me, i would photocopy document, get my mate and go to this garage, see what they have to say (defo take photocopy in garage unless solicitor needs original and garage demand original) After been to garage and got their feedback with your mate as witness, get ya behind to the solicitors and state the all round situation along with what they had just told you at the garage.
Reckon you got a new car mate

The logbook is not proof of ownership, but proof of registration of a registered keeper.
Speak to a solicitor, as it takes upto 3 weeks for a logbook to be returned, and they will of had to of sent the old book off to the dvla long before you went to view the car, providing they had your address before hand.
Also, speak to the DVLA about the situation, as they take logbook fraud VERY seriously. - don't speak to your local office, speak direct to someone in Swansea - www.dvla.gov.uk for the contact numbers.

The police are now involved! and investigating. They said its very strange a main dealer would do such a thin but they expected me to say it was some back street garage.
Trouble is im liable to fines through the dvla! if the car is sold in the mean time and it decides to go through speed cameras etc etc

Still dont get how they had your details i.e for finance.
If you went to look at a car didnt like it and walked away why did you sit down and give them finance details....

Dont see why they got your details at some time b4 you went to look at car
What they do, when you rung them up and said "I'd like to come look at a car", what they say only if you give us all your details
Sorry really dont understand how they got your details.
BUT
Either way am sure you get a 14 day cooling off period on signing loans/finance paperwork, so if this is all legit on your half, then I would suggest you do some sorta search and find out if anything been signed recently and get it cancelled before time runs out, where you would probably still be liable

Maybe he didn't want to do the four hour drive to see the car until he knew whether he would be able to get finance or not, so gave them his details before making the trip...

Like I say the finance side would be my worry
But must have given them summit for them to know your address
Unless they clocked your reg number as you drove off and traced it
Did you drive there in your own car ??

Sounds like the guy gave his details over the phone before he viewed the car for a finance proposal. That way he'd have an answer after the 4 hour trip he mentioned, rather than having to wait while the finance company went through his details.
Also, sounds like whoever filled in the V5 may be looking for a new job
Let's clear this common misconception up:
THERE IS NO LEGAL "COOLING OFF" PERIOD WHEN FINANCE/HP/LOAN AGREEMENTS ARE SIGNED ON TRADE PREMISES.

Thats a bit rough then as you get them with most other credit agreements
What makes the financers the motor trade use that different to any others
Thats what happens when im sure of summit

Cooling off periods are for stuff like door to door sales where the consumer hasn't actively seeked out to purchase anything
Either way, this guy says he didn't sign anything so he's in the right it would seem

Except most of the time they're more expensive

PassionFord Post Whore!!
The cooling off period ONLY applies when you sign away from trade premises - the goods being financed have no bearing on it at all. It was introduced to stop door-to-door sellers applying undue pressure. (Watchdog etc used to be full of stories about the double-glazing salesman still in your front room at 2am after 6 hours of pushing for a signature)
If you go into the shop/garage/office to sign, it is deemed that you thought about the purchase beforehand, and can get up and leave if you change your mind once in there. Once the Agreement is signed, it's a done deal.
