Default Legal Advice Workplace

Right need some legal advice for the work place....

To cut a long story short...


went out with this bird for 2yrs, we worked together. Broke up with her and am now going out with someone else who i also work with and who also works with my ex.

Now my ex and me have been on bad terms. She would be a dick to me in texts and i would be a dick to her, but when we are in work neither of us have brought it into work until now. She sent her father into my place of work and said that i threatened to kill her etc which is a load of bullshit, this girl is a bit looped. Anyway her father is a solicitor and he has said he is going to put an injunction in against me. Now ive never brought anything into work its always been her, but can I lose my job over this even though its her bringing it into work.

She says she cant work there anymore as she feels sick around me, surely thats not MY fault. If it went to court for an injunction would they seriously listen to her? She has no proof that i threatened her, obv because i didnt, she said it was all verbal!

What proof is there that you've verbally abused her ? Have you ever hit her or displayed any voilence towards her ? If not, then to my mind why would a judge take any action against you without evidence ?

The old man sounds like a cum stain to be honest and if he's a legal man he should know better.

As for work, if it was me I'd tell them what's going on. Pre-empt any problem by letting them know the score first. If she feels sick about being round you then she should get another job. Jealousy mate..........

Ive never hit her, verbally abused her yeah but no1 has ever been around. I thought her father would know better, If it went to court and he got an injunction against me that would mean i couldnt work there anymore hence putting me in unemployment which wouldnt be good. My manager is also a dong though, ive already told them before she is loopy and whats next a sexual harrasement claim, so they know to look out for her being like this. My opinion is if she cant work because of me thats her choice, I am not to blame...

Question is CAN I BE SACKED OVER THIS?

No. If it's nothing to do with work and your work isn't affected then there's no grounds for you to be dismissed. How long you been there ? If over a year you have to have verbal and written warnings before being told to go, unless it's gross negligence.

If your boss is a helmet then fuck it, go over his head and and speak to the man at the top, explain the situation.

Ive never brought anything between us into work, it has always been her. Surely if she cant work there then SHE should find another job not me.

Ive worked there for nearly 3 years now and never had any sort of verbal warning never mind a written warning!

So therefore there's no grounds for dismissal. No warnings, work up to par. If there's issues outside that are affecting work they will be involved but like I said, pre-empt it by seeing the bloke at the top and wording him up about what's going on.

Your ex and her old man sounds like a pair of wankers BTW......

They are a pair of tossers! You think if he had any balls he would come round to me house and speak to me personally.

There are issues outside of work affecting her work, she says because i texted her the other day she doesnt want to come into work. I texted her to say have a good xmas and i hope we can get on and not fight, she then turned that into an arguement and went mad!

Its not a criminal issue, granted an injunction can be issued, but they will struggle to enforce it because of your job... I think you will find the key here is the fact NOBODY is legally allowed to stipulate where you can/cannot work. You have a legal right to earn a living (gotta love some EU laws pmsl)

This also applies if you have a contract which states you are not allowed to work at a competing company within a ccertain radius.. NOT legal.... good enough Lawyers can overcome this

Write a letter to your employer stating the whole situation. That way you're covered. And no, a judge will not place an injunction without un-deniable proof of violence and/or threating behavior.

Nah !!! If it went that far someone would need to see the text and see what you've written. Hardly incriminating is it - have a nice Christmas !!! Silly cow needs to curtail that jealous streak - that's what this is all about...........trust me.

And the old dick, sorry man, should know better. Speak to CAB but mate, whilst I'm not a legal eagle I can't see where there are any grounds to get you out. Yeah, your firm might drag you both in and give you both a bollocking if it gets out of hand but what else can happen ? Like I said, unless something real serious happens (ie you clump her or abuse her on the firms time or premises) what can they do ?

Excellent advice so far here peeps, so do you think the best thing i should do then is speak to my solicitor 2moro and to write a letter to the chief wig of the company and let him know!

Dont text her or answer her texts or communicate with her unless in the presence of others, it might be to your disadvantage otherwise.
Save any texts she sends you though, they might be usefull.

Sounds like you are better off without her.

i worked at a place when i was 18 who introuced it just cause of a similer issue that i got my self in


they ignired that but "performance managed" me till i quit

Apparently my works legal people are "croner" and they have said that even though stuff isnt happening inside of work that they need to show that they are looking after their staff and ask me a load of questions about this whole thing.

but the latenes thing was a joke and so was the turning up for work considering i used to arange late night partys when i was working BEFORE i had the issue

the boss was cool but when that happened he changed and went all rule book on me


cant blame him though tbh and when all the fun in my job stopped it was time to leave

Nearly every time some one mentions a problem at their work place, you pop up and regal us with one of the many stories of you getting fired or sacked or fighting with the managers. Everyone fucks up in their life from time to time, and I would guess 50% of the users on here have been fired in their past.

However, thats understandable when you are younger but you're not far from 40 and still "an angry young man" which is just pathetic tbh.

FFS people

you guys need to understand what my job was first, i wasnt a doctor or anything

i was a booking person for a halls of residence for over seas post grad studants in russell square, part of my job was to make sure the "guests" where happy and comfortable due to em being away from home ect

we used to work night shifts due to being a world wide thing and so me and another member of staff came up with the idea of late night comfort drinks for the residents to get to know the members and feel welcome

all was well and good too, it was technically wrong BUT most people knew about it and agreed with the idea


what happened was the worst case senario and so they had to follow the rules and i was too used to the way it used to be thats all


god none of you ever turned up to work drunk then , must be just me


hell when i managed a shop in kings road i used to go out on the piss and then sleep in the shop to make sure it was opened on time,,,,,,,, most of the time though i got a cab from a wine bar in st johns wood to open up on time STILL holding a bottle of becks and then sleep in the stock room till 2pm

guess you guys work to hard is all i can think of

never take life serious, i havent and i seem to get by in life quite well imo

I would speak to your own solicitor first and if its your company solicitors interviewing you then decline until you can have yours present. This is not being awkward or anything so dont view it this way.

Also remember she may have saved the text mesages you sent her so be careful what you do say and make sure you tell your solicitor the whole truth. He or she wont care if you are guilty or innocent and will defend you to the best of there ability. The amount of people who post up threads on here about poor british justice never tell the whole story and turn it to suit themselves. A real legal person sees through the bollocks posted, the mate `Who knows all about the law` does not.

I would also stop going out with the staff in your workplace as this will only lead to trouble as bar girls tend to be young immature and bitchy to each other at the best of times so this will ensure a lot of back stabbing especially if any of the impressionable young girls have a crush on you.

I was in La Lea last night and you should have heard the fitness first girls bitching about each other behind there backs to us and each other.

hey i have no regrets at all leaving that place, hell i lived the job and it was ME who fucked it up totally, i cant blame anyone, infact i made it too easy for em tbh just by being a fuckwhit whoi enjoyed going out alot more than working and i left that job and went to manage a shop in kings road chelsea for my old boss

again no regrets there, from the age of 16 to 21 i ahd the best times of my life, never had ANY regrets at all, love every min of it, prob why i talk about it

again, im far from angry

im sitting here drinking moet champers and typing on a pc cause ive ran out of stella

hardly the actions of a manic depressive

infact ive got a job i love, ive got a missus who i broke her thumb and shes never complained about it and said i was silly to appogise and my little girl was used as a angel in her school play


think i got about as normal and happy life as i can think of


i just hate being picked on or ripped of by governement bollox to scam cash from people

nothing to do with my personal life though

actually i run the front counter on a ford parts department and i drive the vans when people call in sick as i dont mind doing any kind of work, i also work at various branches too when meerly suggested aswell as docklands mazda parts too as i quite like learning

i also work for the service department when required and get enough of a wage for my missus to be in college and have my own place IN CROUCH END and a child too

fook me i must be badly paied


i also drive a ford ranger that the group manager has and when redundencys where being handed out even though im the newest member of staff there i wasnt even in the meeting for redundency


im also getting a company car to allow me to run the parts department in january when the part manager is off in potters bar which is about 40 miles from my home


guess you could say i just love my job and cause of that i dont mind what i have to do aslong as the job gets done

hell i even painted the floor weeks ago as the place started looking grubby

btw fords parts advisors in the city get paid OK as it goes, could do with more but who couldnt, i never even mentioned i was "poached" from another dealers by my boss as even though hes a group manager he also enjoys having a laugh too


working at halfords which im sure you refer to was due to my missus getting a decent wage and i wanted a job i enjoyed and so i RAN the bike department,,,,,,,,, ive never worked on ripspeed or worked the tills ect there

i was running a department ( badley and into the ground if im honest as i couldnt be arsed to sell there shite)


seriously mate im far from angry, i enjoy life to the full and the final part i needed was a job i love,,,,,,,,, and i got it now

Ryan Belfast - I'm sure you'll be fine with your situation, the fact that he came to you and told you verbally sounds like he's just trying to shit you up. If he meant business he'd have sent you a letter (or have you got a letter - i couldn't tell as there were too many rubbish posts in between by a certain someone ) and wouldn't have come into your work to tell you.

The moral of the story is 'don't pork the payroll'
