Just bought an iffy car,Your thoughts !
Bought a car from from a dealer in birmingham yesterday,mrs been driving it around,said a knocking coming from front end(suspension).Anyhow jacked it up,did the usual moving and proding,nsf wheel bearing.loads of movement
,can't find the knocking though,although i just driven it and can hear it.
Phoned the dealer,got all moody on me(to be honest so did i).Said" i sold it as seen".He said drive it back and will have a look.You must of driven in into a pothole.Anyway gonna take it for an mot tomorrow,what happends if it fails ?
Was an 06 fiesta by the way

"Sold as Seen" means exactly fuck all!
"Sale of Good Act 1982 - Goods must be fit for the purpose for which they are sold." This goes for second hand items as well as new. Get the dealer to sort it to your satisfaction or get it sorted and drag their sorry arses to the small claims court
Mind you before ripping the guy a new arsehole you really need to give them the opertunity to rectify the problem(s)

also tell him your taking it for a mot and if it has recently been mot mention your taking it to vosa
just txted him,can't speak to him again,i'm fuming,if it fails will phone trading standards,I really don't wanna be driving it back up there.mot runs out in april.I know won't cost much to fix,but,to me,its a pure piss take,i should have recorded his attitude on the phone.Reckoned he told my missis,was sold as seen when she origionally phoned him up.He said nothing of the sort.When she disputed it,he called her a liar !

Never had a front wheel drive car have play in a wheel bearing before. It must be well shagged for that and i dont think a pot hole would cause that sort of damage. Hope you get it sorted at the dealers expense. I hate people passing of cars like this and making money on it. Good Luck matey.
In that case it blatantly falls on the dealers head. Keep calm and know what you want.
1. Make it clear that you are expecting them to rectify the defect at their expense.
2. Point out that there is nothing on any of your paperwork to support the claim of sold as seen.
3. Point out that "sold as seen" carries no legal weight and the Sale of Goods Act 1982 states that goods muct be fit for the purpose for which they are sold and I beleive it also mentions that they should be of servicable quality.
4. If they don't agree to rectify the fault you will file a complaint with trading standards, have the repair done and take them to the small claims court to recover the sum and the associated costs of the temprorary vehicle whilst yours is being repaired.

I went to a Volvo the other year and looked at some trade in cars they had for sale, was told 'no warranty, the car is as is it' not even a test drive!
Not sure how that works, in the past I always thought only trade could by 'sold as seen' from trade?

the sale of goods act is a bit of a grey area really in regards to second hand/used items.
if the paperwork states sold as seen and no warranty then you will probably get nowhere.
on a test drive you should have been aware of a wheel bearing problem.
our 206 showed up a wheel bearing problem on the test drive and they sorted that before we bought it.
the best thing to do is get on good terms with the dealership, i believe there is a cooling off period for any items bought as long as they are returned in the same condition they were bought. proving the damage hasn't been done since could be a problem though.

lad i worked with bought a rover for Ł1400 off a dealer,2 days after buying it engine blew up,he called the dealer and they said sold as seen,so he went citezens advice for help and was told any car sold by a trader/dealer over Ł1000 automatically has 3 months warenty,so he went back to dealer and they HAD to sort it
As said above. Unless the receipt states sold as scrap then you have 3 months warranty by law. I sold a car for a customer a few months ago, wrote on the receipt, "sold on behalf of another party, no warranty given" long story short, car went wrong , I had to put it right. Lesson learnt!
