Alright dudes,
I parked in an NCP car park today, in my wife's car got up the street and realised I had forgotten to pay and display, went back to the car park and purchased a ticket, went back to the car and there was a "Parking Contravention Charge Notice" on my windscreen. I was so pissed off I just drove back home. I parked at around 12.50 and the ticket was issued at 12.55, the pay and display ticket had 13.02 on it.
All the usual bullshit on the ticket, 14 days to pay £50 or it will double, debt collectors, courts blah blah blah.
My wife wants me to appeal to them, but I don't want to admit liability.
What should I do?
Pay?
Appeal?
Ignore?

Ignore them. Chip seems to have had a few dealings with these people.

 

Also, what should I expect? A few scary letters?
My wife's scared they send debt collectors to the door!
How long till they stop trying to make me pay?

 

if a "debt collector" comes to the door you politely ask them to leave your property or you will call the police for them trespassing

 

if that dont work then nothing in the house is yours its your mates/wifes/kids/family members!

all id do tho is send a letter with your photo copyed ticket saying you couldnt find a machine-was a long que or some other excuse by the time you got back with your ticket you had that on your window!

youre talking about dealing with BALIFS who have a legal right to your stuff.

what we're talking about here is nothing more than a beggar turning up on yuor doorstep asking you to give them money with zero legal right to it. you just tell these people to leave!

 

Debt collectors don't have the same powers as bailiffs.
They can't enter your home or take your possessions. They can only write, phone, or visit your home to talk to you about paying back the debt.

Firstly you need to clarify what the ticket is. Are NCP operating the car park on behalf of the local authority? Is the fine marked as a "Penalty Charge Notice" or a "Parking Charge Notice"?

If it's a "Penalty Charge Notice" you need to either appeal or stump up the money and pay the fine or they will come gunning for you and have the power to do so.

If it's a "Parking Charge Notice" throw it away and ignore all correspondence.

It's imperitive you find out with which you have been issued

 

Aren't you meant to get 15 mins to sort getting a ticket anyway? I'd go with what Oranoco said, but if it is a penalty i'd be kicking off without a doubt.

I've to send payment to NCP or pay online on their website.

I havent ever paid a non council or police parking ticket and have never been took to court, its civil matter not a legal one ignore it.

Ignore it matey they'll send you reminders but just ignore them and don't enter into any correspondance with them, it's not a PCN it's a parking invoice which you don't have to pay.

Only the council can issue PCN's not private companies, plus they have never taken anyone to court and won because law says they are not enforceable.

 

As it isn't a local authority ticket, they have to rely upon normal contract law principles to enforce as they have no statutory powers (unlike the Local Authority). In other words, they will be claiming that you agreed to the additional parking charge as you contracted with them when you left your car in the car park. However, under contract law any additional charge must be a genuine estimate of their loss (liquidated damages). If it is more than that, it is an unlawful penalty charge In this case, £50 is not a genuine estimate of what they have lost so it's a penalty charge which they cannot enforce.
