Default My neighbour

I went to lego land yesterday as it was my sons birthday and when i come back my neighbour had chopped down the hedges that seperates our houses just leaving stumps sticking out the floor.

it now looks terrible, he didn't speek to me as i certainly didn't want them cut down, they have been there well over 10 years and i spent last night taking the stumps out with a tow rope and my hire car .

the hedges where on the left as you look out of my house but surely even if they were his he should have asked first,his house looks like a shit tip and now so does mine so should he pay to put a fence up or should i as my 3 door is coming back this week and it sits on a very open drive now.

i don't talk to him as he is never there, he rents it out to students but surely he can't leave it open, whats the point in me having lockable gates on my drive as now you can just walk through from his.

you definately need to talk to him mate, legally i dont think you have anything to go with but out of courtesy he should have come to see you.

he has a duty to keep your property semi secure if he has made it unsecure with out asking.

Just out of courtesy if nothing else.

I would be knocking on his door.

Do a search on the land registry site that will cost you Ł2. This will show which side is your responsibility.

It wouldn't of hurt for them to of spoken to you about it though ...

If it's your side and it shows this on the LR then they will have remedy it to your liking. It's also criminal damage. I doubt they'll get arrested but none the less it still is.

If you need any advice then a friend of mine who is here now is a legal bod that deals with neighbour/boundary disputes.

Land registry couldnt tell me fuck all about mine. We still dont know now.

Not everyone has there deeds though.

Edited to say that if LR don't then they need to be asked the question why not as they get paid a fee for supposedly doing this.

What a wanker,not consulting you first.I have a similar problem where I live but it's more my fault really as some wood fell down in the heavy winds and broke some of their fence (your fence incedently is the left hand side as you see it from the street).the fence is literally a few shitty posts with bits of half cut logs on them,a good 50p's worth!!Below that is a wall that's completley fucked,only a brick high which they've now decided to dismantle and put all the bricks on my side,although it has fuck all to do with me and they said the other day that they'd put the bricks on my side for when I rebuild the wall!!!!fuck off,I screwed a few bits of feather edge into the posts and left it at that,I showed them that the whole wall is shagged and no more was said.really,it depends upon your relationship with the guy as to what to do about the fence/trees etc. I don't think you can do anything legally about it but you could say your not happy and offer to go halfway on the cost of putting a new fence up otherwise your paying for it yourself if it bugs you.I think I'm going to have to fund it out of my pocket in my house as I don't like the lack of security of people getting in through theirs,it's mega low crime where I am but still.I think 6'6" is as high as you can go on a fence,plenty really.

i think im going to put a 5 foot fence up just on my side but still can't beleive he can take it down and not replace it with anything.

it will cost me a couple of hundred and so far iv dug 1 hole and already have 2 plasters on my hand, just pissed off really as iv already had 1 car stolen and don't want this one on full veiw although i know the pikeys that stole the last one no i have this one.

he rents the place out and i think he even has a bed in the living room which if there is a gas fire in there could be against regs, i may look into it.

Sorry it's happenned mate,nothing worse than wanky neighbours.my old girls neighbour and the guy next door down are having problems funnily enough with hedge/border issues.her neighbour found his little daughters rabbit cage open with the rabbit gone,they've laid a new garden but he's on a water meter so my mother offered to let him use the tap by the swimming pool to wet it overnight.my mother could hear banging in the night and noticed the door to the conservatory over the pool was not shut properly.went up to look and the tap had been turned off and the doors a bit dodgy to close so he'd obviously panicked and come out the other door instead which you can't close from the outside.it's not like they live in a shit area either,there's just wankers about.going back to your problem,if he's using the downstairs room as a bedroom then that makes it a HMO or house of multiple occupancy which brings up a massive amount of regulations,sink in each room,fire doors etc etc so you could really stuff him there.

Yes it is i believe, you cant have a fire etc in a place where you sleep

think the legal limit without planning permission is 6ft ... anything over that and the council get involved .. i know as we had to put 1 up and its a fraction under the legal height...

Ultimately he can only mess about with the fence that is his responsability.

But saying that he also has a responsability to consult anyone on adjoining land about anything he does also.

He has broken the rules.

well tonight iv put a 4ft fence up, plus gravels boards, plus trelles on top cost me just over Ł350, money i should not have to spend as its not me that have taken it down, its just on my side so he can't say anything about it.

don't you just love neighbours.

The things is, as new fence is on your side, you've lost space in your garden now. I wouldnt put up with that.

As far as I can see, he has chopped down the trees which belonged to you, and now its cost you money. I certainly wouldnt let that stand mate...

Who's side were the trees on?

Who maintained and pruned the trees?

Do you own the house or is it rented?

As stated check the deeds if you have them, you could either put up a fence or plant more trees, up to you. If the trees were on his property its his shout, I agree its out of order for him not say something though.
Trees always cause domestic disputes, its quite a popular one especially when they grow tall and become an issue with maintenance and blocking out the sun

how high was the hedge, not sure about your area but up here if its over 6ft you need to talk to the local council before you cut it down.
