Default my cars just been written off :(

gutted some arsehole in a 57 plate mondeo compay car has just smashed into the back of me admitted i came round a corner to find a disco on my side of the road i slammed my brakes to have this bloke go straight into my arse end , i no my car is only a 1.4 mk5 esco but it's all the memorys and effort i put into it to keep it looking nice i'v just had 2 tyres put onto it and a new shock cos i'd blown my other PI one out i can't believe some people i just wish they payed more attention

i was shocked cos i'v never been in a accident and i honestly didn't have a clue what to do, i knew i had to take his details but other than that i was lost , still really sad and now my neck hurts too, them bloody rs200 seat headrests are really far back

i'v got piccies i'll have then up in a min it's not major but bad enough they'll right it off cos of the car's age and value but i'm sure you no how i feel when it means more to keep the car than it's actual value

i would honestly get to the hospital about your neck! if its hurting then you almost definately have whiplash! up to you if you claim for it or not, but a guy i know had a slipped disk in his neck after whiplash, so it could get serious.

atleast you are ok. his details are all you really need, possibly some pictures of the cars & location & damage. all where the accident happened including cars if possible. although seeing as he went into you it should be pretty clear cut! hope yo uget it sorted chap!

cheer's for that lads yea i'm still getting over the shock cos it's my first real accident, i'm not having any luck neither i'v just been laid off and was supposed to be going into another job that has been pushed back till sept i'v my misses 21st coming up and this is the last thing i need , i only ever seem to have bad luck it's gotta change eventually it's just not possible to have all this bad luck all the time

It's a little known fact but his insurance cannot write your car off as "uneconomical to repair". You are entitled to have your car repaired to the standard it was in before the crash without detriment to yourself. This is a statute of UK civil law and non negotiable by the insurance companies.

They can only write it off if it unsafe to repair - i.e. major chassis damage etc and then they should offer you market value for it.

If however you are happy to take the money, ignore everything I have just written above - just don't take their final offer and do some research of how much cars are selling for in the same nick as yours was before the accident.

umm no mate if the damage is more than 60% of the value they just pay out for the car, you can then chose to buy the car back at normally around 10% of the payout.

good luck getting a decent payout the book value will be about £300

i think i would be going down the compo route to claim a little more back!

No, you're wrong. That would only apply if you are claiming off your OWN fully comp insurance.

ok update i'm only 3rd party insurance but took legal cover which entitals me to a hire car so atleast i have a little good news i'v done a slight repair just to keep me going for a couple of days if i get bored it involves gaffa tape "bodge", i'v now just gotta phone the blokes company up and get his insurance details so i can start the claim atleast i'll be getting better motorway milage than my little cvh 1.4

yea i no thats what is gutting i'v put some effort into the car and for me to get £300 back is just bollocks imo, atleast i got nearly a years worth of enjoyment and motoring out of it, but i'v deffo got a sore neck so i think i might try claiming a little back i'll see where it goes

and well it don't really matter now lads cos i'v looked under the car and one of the rear chassis legs was rotten and has crushed in the accident so you can stay friends now

Its not too bad, buy the car back off the indurance (assuming they write it off), bit of work with a sledge hammer and block of wood, soon be straight again.

Put standard wheels back on car befoure it goes to the repairer, also remove any other modifications air filter etc!

i really like the car and would like too repair it, but with the chassi leg fucked too it's just to much work without the time to do it, if i was still working in the body shop i would be more content in fixing it but the hole back panel will need pulling out new boot and some welding underneath and boot floor needs pulling and welding too, then the front sorting out too it'll be a money pit for a £300 car i just can't justify it atm with the way my money situ is , really sad moment though cos i did like the car alot, just shows all it takes is some plonker not paying attention

i haven't got the steelies but i have got a set of 15's that are fooked will i get away with blagging them and atleast i still have the original air box

Not sure mate, could try blagging they came with the car and you wouldnt have known if they where standard or not, unless you have told your insurer it doesnt have alloy wheels?

at work at the mo we have a saxo vtr, compleatley standard apart from a piper cross air filter.. now this car is a compleate write off no questions asked (side damage, rear subframe broken in half wheel, hub, brake etc all off the car!)
the claim has been put on hold due to the air filter and it looks like the insurer's are trying to not pay out because of the air filter... make of that what you want.

well mines a carb CVH so putting the standard air box will be a 5 min job and i never told the insurers that it didn't have alloys on when i brought the car so thats covered me there

if the car went to the garage i recently left they wouldn't of noticed anything so looks like some accident repair garages do, do a proper job

That's a shame, looked repairable otherwise.

I hope the other party didn't take a photo of your car with the alloys on if you haven't told your insurance.

no no photos where taken at the time of the accident and the 15's that i have are exactly the same just smaller TSW alpines so even if he did it would take a keen eye and someone that is bored

and yea the chassis leg is a proper bummer atleast it wasn't any worse cos it could of been me getting crushed if it was going rotten like that

I dont understand why people dont declare all mods.

If you were to (god forbid) kill someone, you would be paying them off for the rest of your life.

I told them about the 18's I have on my Golf, it raised the premium by FOUR pounds.

i no but i just forget that you have to declare your alloys wouldn't it improve your braking in time of an accident though i can understand if i tried to claim for them and didn't declare them in the first place and well i was paying £1500 third party to insure my esco cos of my past so i don't think it'd of been 4 pounds for me but point taken and tbh that is it just wheels and K&N and that was only to try and improve my MPG the rest is standard exhaust everything so i'm no angel but nowhere near as bad as some people out there though
