ok update i'm only 3rd party insurance but took legal cover which entitals me to a hire car

so atleast i have a little good news i'v done a slight repair just to keep me going for a couple of days if i get bored it involves gaffa tape

"bodge", i'v now just gotta phone the blokes company up and get his insurance details so i can start the claim

atleast i'll be getting better motorway milage than my little cvh 1.4

yea i no thats what is gutting i'v put some effort into the car and for me to get £300 back is just bollocks imo, atleast i got nearly a years worth of enjoyment and motoring out of it, but i'v deffo got a sore neck so i think i might try claiming a little back i'll see where it goes

It's a little known fact but his insurance cannot write your car off as "uneconomical to repair". You are entitled to have your car repaired to the standard it was in before the crash without detriment to yourself. This is a statute of UK civil law and non negotiable by the insurance companies.
They can only write it off if it unsafe to repair - i.e. major chassis damage etc and then they should offer you market value for it.
If however you are happy to take the money, ignore everything I have just written above - just don't take their final offer and do some research of how much cars are selling for in the same nick as yours was before the accident.

umm no mate if the damage is more than 60% of the value they just pay out for the car, you can then chose to buy the car back at normally around 10% of the payout.
and well it don't really matter now lads cos i'v looked under the car and one of the rear chassis legs was rotten and has crushed in the accident so you can stay friends now
