Default letter from council wtf

came home from work today to find this letter

RE:USE OF PROPERTY FOR VEHICLE REPAIR

I refer to concerns raised regarding the above

i have gathered evidence that you are using your property in connection with the above business. in order for me to fully assess the need for planning permission for the use of your premises for this purpose, it would be most helpfull if you could provide a log documenting the way your premises is used over a fortnightly period. the log should give details of when vehicles not belonging to you are parked at your property, when repair work takes place, and when employees or customers visit your property in connection with this business. on the basis of the log, I will give you a decision on weather planning permission is required.

wtf!!!!! the cars on my path are mine+dads, lil bro
the only car i work on is my fiesta turbo and thats only on sundays if its dry lol
i do have a few cars on the path

dads cossie
my fiesta
mk3 cabby
bmw 320
bro fiesta

makes me laugh because the cossie, fiesta ,cabby dont even move!!!! and the rest are daily runners anyone else had this??????????

if you dont run any business from your house then just tell them, job jobbed.

Pisser that you got a letter i know, but it must be someone who lives near or drives past your house alot.

Dear Sir,

The use of my property is for that of a domestic use only. I do not conduct any business activities from the property and as such your concern is not justified.

The vehicles on my property are either in my sole ownership or in ownership of those residing at these premises.

Kind Regards,
Your mum

I think I would write back to them and ask them to present the evidence they claim to have gathered.

now that is classic.

My mate got a letter telling he he was not allowed to use his drive as the kurb was not dropped and if he did he would be prosecuted.

So, that night he parks on the road as does his misses, a drunk kicks a dent on the misses fiesta and his clio.

Next night he stick the cars back on the drive and has never heard anything again.

I did read somewhere that you arn't suposed to carry out any work on your car, but that may have been on the roadside??

Dead easy to sort out - just send them the details of who owns the cars and thats it.

Then remember to make LOTS of noise about fixing them next time! LOL

100% you've upset a neighbor. Write back and tell them you only work on your own car. Invite them round for a cuppa.

Someone has definitely complained mate. The Planning Enforcement service of your local authority is not set up to be proactive, so relies upon information from members of the public.

You should just write back to the enforcement officer and say that the use of your property is residential, that you do not conduct any business activities from the property and that your hobby is working on your own car from time to time which is incidental to the use and enjoyment of the dwellinghouse. Accordingly, there is no breach of planning control. However, if he has any evidence to the contrary, you look forward to disclosure of the same.

I would not bother providing a diary/log to him. The only reason he wants you to do that is so he can attempt to prove that the car repair/maintenance activities have gone beyond what can reasonably be considered a hobby. In other words, he wants to use your diary as evidence against you. Let him gather his own bloody evidence!

You do not have to give any other information unless you are served with a PCN (planning contravention notice).

basically g you have a cunt of a neighbour who don't like you messing about with motors, this is from experiance............... tell the council you have no office, phone number, ramps, etc etc to run a motor repair buisness and any cars seen are family or friends visiting and if seen under the bonnet of a car your just topping up the windscreen washers or somthing. they are calling your bluff and if you agree you shoot yourself in the foot,if you laugh it off and suggest they are making you out to be a garage repair buisness when you clearly are not due to not having garage facilitys they shut the fuck up.

look for the neighbour who can't look you in the eye and make a mental note for retribution.

No your not as theyd have to gather a lot of proof that you were working on cars as a business. It would never get there. As soon as they run the number plates theyd realise theyve got no case.

its more likely to be the neighbour who seems decent and chats to you thats stuck you in to try and put the suspicion onto someone else. burn everyones houses down just to make sure.
you can nip it in the bud by telling them who owns the motors to put an easy end to it or you can make it awkward for yourself by not co operating but if you make it awkward theyll all be harassing you for all sorts of bollocks in future..

eh !

i know they put it to you your running a buisness and then tell you you need to be applying for planning permission to run a motor trade buisness from home,if your daft enough to agree the shit will hit the fan, if you contact them and fob the twats off thay need proper proof like sending someone around and you doing work for them or discussing buisness with a undercover council official

first thing you need to do is check what the council rules are for your area,
if you do write them a letter don't say that you work on your own cars, as this may not be allowed.
simply tell them that the vehicles belong to family members who live at the address, even if they don't. they could argue that you are storing vehicles.

surely on private land you can work on your own/family cars as much as you want within planning consent for a domestic dwelling??? otherwise garages are illegal as they are designed to be capable of being used 24/7 etc.

Its a simple case of a knobber on the street, nothing more!!

warren the council do it because they have a complaint in writing with a name and phone number or address they can contact to see its not a hoax complaint.
they won't of just picked on g they are acting on a report.

Had the same thing happen to me last year, in fact i think i put a thread on here about it. Council came round randomly for a couple of weeks to check up on me, eventually they were happy i wasnt running a business.. i only had a fuckin mini on my drive! So for the next 2 weekends i made as much noise as i could just to really fuck my neighbours off.
