Default caught doing 122

not me, but a mate(cock) recons his missus got caught doing 122, 9 months since passing, already has an sp30, and apparently only got 21 day ban, and £100 costs. Is he talking shit or do they not always give points.

What about if it was only 90, surely thats still got to be 3 point minimum no matter what?

it depends on weither it was ur 1st traffic offence, where it was, time of day/night, age, car you were in..... all balances it out.... they can give a number of different punishments.

I got a two week ban and £250 fine for 107mph in my old mr2 super charger.

Its at the judges discression, depends if he got his cock sucked the night before basically!

They can issue points and a ban, if the court so wish and you were caught doing 200mph they can let you off, 30 mph over does NOT mean a ban, it normally does, but it IS at the discretion of the court.
If within 2 years of passing your test you amass 6 points you are disqalified and have to resit your test, no exceptions.
NO way in hell would a court not ban a newly qualified inexperienced driver for 122mph, they would love to do it, to send a meassage to others that have just passed as this is the age group late teens with the highest accident rate.

So much conjecture. As one or two people have said above, if you're doing 30 over the limit on that particular road, then it means they have the power to ban you. I got a 56 day ban and £385 fine for 102 in a 50.

The hardest part is explaining to dumb-fuck insurance companies that you can have an SP30 with no points!

a mate of mine got caught at 128 he got 21 day ban and £600 fine no points

depends on the judge imo

Sorry to seem like I am picking on you, but you get points OR a ban .

The only way you can have points AND a ban, is from the totting up procedure, but then after any ban, your licence is wiped clean of points for you to start all over again anyway, so effectively - you don't get points as such with a ban (if you see what I mean).

Example 1:
You already have 9-points on your licence, but get an additional 3 for a speeding offence and reach the magic 12 for totting up. Providing you can't prove to the court that losing your licence would cause undue hardship, then you would get your licence automatically suspended . When you get this back, it will have nil points on, but show the period of suspension plus a code for what this was for.

Example 2:
You already have 9-points on your licence, but get caught doing 30mph+ over the speed limit. This requires a court appearance and a ban is almost a certainty (again unless you can prove undue hardship from having your licence taken away). If the courts decide to ban you (even if this is only for 14 days), then despite your 9 points not being previously spent (as in they were still within the 3 years), you would get your licence back with a "clean slate" (albeit showing your ban on it as example 1), ready to start again.

Example 3:
You have zero points, but get caught doing 30mph+ over the speed limit. This requires a court appearance and a ban is almost a certainty (again unless you can prove undue hardship from having your licence taken away). If the courts decide to ban you (even if this is only for 14 days), then you would get your licence back with a "clean slate" (albeit showing your ban on it as example 1), ready to start again.

Example 4:
You have zero points, but get caught for a multitude of offences that when "totted" up cause you to reach / breach the 12 point mark, providing you can't prove to the court that losing your licence would cause undue hardship, then you would again get your licence automatically suspended. When you get this back, it will have also as previously mentioned have nil points on, but showing the period of suspension plus a code for what this was for (usually the most serious of the offences).

So as you can see, you don't get points AND a ban, it is one or t'other. If one leads to the other, and a ban is given, once this is served, clean slate scenario applies, so nil points .

I can vouch for what Mike is saying, I got banned for 7 days for doing 102 on the M1, when the judge read the sentence it was Disqualified from Driving for 7 Days, 6 points and a £200 fine £20 costs.


I paid and went on my way, when my licence came back it just had the ban on it, no points.


If you are just over the 30mph over the prescribed limit like I was and Clare was, if you have a letter from your employer saying you would loose your job etc etc then you can get let off with just points and a higher fine, but its at the courts decision.

I'm now clean as a whistle, but have not bothered removing them from my licence (which shows 19, all of which are spent and can be removed) . So I AM speaking from experience, not what man down't pub says .

Regardless of the speed, the second conviction for speeding should result in an automatic ban and a return to Learner Status...

i have a very colourfull past inolving traffic offences and have had to appear in court twice this year on the first appearence i was doing 87 in a 50 just coming off the severn bridge for which i went to court with a clean licence to which i got a 42 day ban 20 days later i was due in court for doing 125 in 70 on new years eve which every one said i was going to get a year ban for as this would be the sixth ban ive had in the uk but the judge must have been having a good day as all i got was six points and £100 fine

Isn't it stupid how it isn't consistent? Why do some people get banned and others don't?

I got caught doing 104mph on the A50, went to Court and got 6 points and a £220 fine, to add to the other 3 points I already had.
