Default Legal advice... any bods here???

Long story very short LOL...

Its involving a dog attacking another 2 dogs, (the other 2 dogs seriously injured but ok now)

The dog in question is a retired greyhound, which was consiquently put to sleep at the owners discretion.

Now to cut a long story even shorter the owners of the other 2 dogs want there vet bills paid for which tally just over 3.5k between them.

The owner of the greyhound offered them some money as a good will jesture as it was a terrible accident which they declined as they said it wouldnt cover the bill etc...

So last week the grehound owner recieves a letter with the vet bills attatched saying that if he doesnt pay the bills then they will sue for personal injury as they are now claiming the dog bit one of them.

The police have contacted the greyhounds owner and have said that the other 2 dogs owners want to take the third party to court etc for personal injury, Its now come to the greyhounds owners attention via the police that the owners of the other 2 dogs DID have pet insurance and have had there bills paid..

Now what i would like to know is how would that stand as they have claimed they have no money to pay for the bills etc,, and have fraudently claimed from insurance and are still trying to get money from the other dogs owner??

Would like others advice on this please.

If they have commited fraud, which they have NOT, it would be up to their pet insurance people to take action.
They DID have pet insurance, but may have had an excess to pay which they can certainly recover from the gulity party, through the courts if necessary, BUT only if over a certain amount.
If they are now trying to get back monies which they say has been paid out of their own pockets, but wasn't that is a matter that can be dealt with by their insurers if they want to, very unlikely.
As they have NOT (yet) received any reimbursement, then the only offence that could be would be ATTEMPTED fraud.
I can absolutely gaurantee you the plod will not be interested, but as said they certainly are able to claim their excess if any.
I would NOT listen to the plod, too much if I were you, they may well not know the whole story, and are quite good at getting things wrong, and at stirring the poo.
If I were the dogs owners who were hurt I would give the other attacking dogs owners details to the insurance co as it was not under control.
The plod should also have taken action under the dangerous dogs act against them.
If one is now sunsequently claiming to have been bitten, they would stand no chance unless it was suggested at the time, and medical evidence obtained as to the extent of any injury.

Thanks Tabetha,

The dog has never bitten/attacked anyone or anything before, it was a shock to all involved even the dogs owner as it has been a family pet for 7 years.

As said the third party did infact offer a good sum to compensate the ladies involved but they declined as they said it wouldnt cover the vet bills, I now know for a fact that the bills have been paid via the ladies insurance yet she still wants the full amount from the third party aswell

i just didnt realise that she could do that?

If her insurers have paid the bill, as it seems, they CANNOT claim anything other than ANY excess they might have had to pay.
They certainly cannot claimback any money, as it is not them who have been made "out of pocket", it is down to the insurers to persue a claim for this if they wish to recover THEIR LOSSES.
The dogs owners only suffered any excess(?) and can claim that.
House insurance will also cover acts like this from the attacking dogs owners, so the insurance co can also claim on this.
