Got pulled earlier, and cut a long story short the police officer in question assured me:

A) that he could prosecute me for speeding based on what he saw on his cars analogue speedometer, and that he didn't need means of proof from a calibrated & certifiied speed detection instrument

B) he could give me a fixed penalty even though he didn't have a colleague as means of witness to the offence

C) that he is allowed to swear at me

no in the end after a bit of an argument he PNC'd the car, gave me a lecture and i walked away hands free.

But for standing my ground and saying "i know the law on this" he said i was being cockey and started swearing at me etc

TBH my advice would be for you to accept that the policeman gave you a rollicking for speeding, and that you've actually got away lightly.

I find that usually when they are "nice" to you, chances are you will be receiving the NIP (verbal) and than the points + fine appropriate to your actions.

Not many people get away with speeding these days.

In case you know anyone who is ever caught for speeding:

Just thought I would share this with you. As you know I work in the
speeding fine department in Swindon's Magistrate Court and in the course of
my investigation into "fines, their payment methods, and how points are
automatically added against drivers licences" I discovered something very
interesting.

This has been tried and it works.

I tried to send this to everyone I know. I know that for a fact is works so
if you ever get in this situation, you have an out. We discovered that this
procedure works nationwide. Read it and try it. You have nothing to lose
but the points on your license.


This is how it works:
If you get a speeding ticket or went through a red light or whatever the
case may be, and you are going to get points on your licence, then there is
a method to ensure that you DO NOT get any points. When you get your fine,
send in the cheque to pay for it and if the fine is, for example Ł30. Then
make the cheque out for Ł31 or some small amount over the fine. The system
will then have to send you back a cheque for the difference. But here is
the trick; **DO NOT CASH THE REFUND CHEQUE!!!** Throw it away!!

Points are not assessed to your licence until all financial transactions are
complete. If you do not cash the cheque, then the transactions are NOT
complete. However, the system has gotten its money and is happy and will
not bother you any more. This information came to our attention from a very
reliable computer company that sets up the standard database used by each
county's computing system.

That old trick has been talked about for years, pretty sure that doesn't work.

last year i jumped a red light got sent the letter asking me to own up take the points and fine
chucked letter in bin did not go court got a fine no points i was not at court could not give me points

 

if you got a ticket and then went to court,the police would have to produce evidence that the policemans car speedo was corret,by means of a calibration cert.

thats why all the traffic cars have have calibratin certs etc....not the patrol cars.

Funny you say that, he told me how he WAS a traffic officer, he was in an armed forces vehicle, and was wearing all the bullet proof vest and so on.

I got told they can't do you if you tell them you were speeding because of "The Call Of Nature".

Basically tell them you needed a piss and you were trying to get to the nearest toilet.

Call of nature complete bollocks as is paying more they will just cash it and send you the remainder, less the cost for their work!
There are SOME defences to speeding and jumping red lights etc, but the onus of proof is on you.
NO WAY IN HELL, would a conviction stand for this.
NO CALIBRATED speedo + NO EVIDENCE, it is that simple.
Ask yourself, why they have calibrated speedos, and why they have to be recalibrated yearly, if the "normal" one will do ?
He does NOT need another officer there if he has a calibrated speedo.
Give you a ticket for what ?, anything he does you can contest in court, including fixed penalty notices.
He is NOT ALLOWED TO SWEAR at you, even if you call him naughty things!!
If you see him again, ask if you can get done for calling him a CUNT, he will of course say yes.
Then ask him if you can get done for thinking it, he will say no, then say I THINK YOU ARE A CUNT THEN!!

mate what he was trying to do was get you to confess then he dont need evidence as you TOLD him !!!, they are trained to get you to answer there questions and at that point you would have been given a fixed penalty as it aint a court appearence as if it was it would be chucked out !!!

they tried that with me,, the copper actually said hes tranist HAD a calibrated speedo and would i like to test it in court and get a possible ban

they lie like fuck to get you to confess and accept the points,, i learned this the hard way when i got a tug and said to the copper i thought i was tugged cause i never had my seat belt on,,, the cunt then checked me out and the car under the terrorism act found fuck all so done me for confessing to not wearing a belt

now when i get tugged i deny everything and let them convict me,, you dont get any worse off when you lie and they NEVER lessen a sentance no matter the fucking crime these days,,, when they claim that it was in the 70's when they had the supergrass system in place and the petty criminals used to fall for it to admit to stuff/pass info on and make there jobs easier


the main thing woith the police is unless theres a whitness they cant do fuck all,, no matter what the crime and speeding is the same

i was doing 70ish as my missus needed the toilet and i slowed down when i seen the transit headlamps incase and i got away with it,, the copper was pissed off at me

oh and the night i left for the ring i was pulled for doing 40 in a 30 WHEN I WASNT !!! and the copper also threatened to take me to court unless stopped playing the fool and i came clean with him,, fucking cunt as i wasnt speeding as i had my little girl in the car as i was taking her to my parents and had 4 hours to WASTE before i left for the ferry,,, if anything i was driving LESS than 30,,, still aint got a clue to this day why he tugged me and fucking lies to me,,, there was 2 coppers there too


anyway you was right,, just argue, the WORST that can happen is you get the same punishment anyway


hell ive got a few mates inside and EVERYONE of them allways appeals there case,, they ALL get a lesser sentance too,, got a mate who got his murder charge lowered to manslaughter and got 5 years instead of 10 just on a appeal and said the same argument ( which was true) that he never aimed to kill the bloke

when you see what they give people of actual crimes makes you pissed that a conviction of speeding affects your life for 4 years and drink driving/racing ect does it for 10 years

another mate of mine has just served 6 weeks for fraud and he was doing it for a few years,, its a joke tbh the way the system is as you would get the same for not paying your council tax

 

I was talking to a woman who works in the ticket processing office. She told me their office deals with around 40,000 tickets a month. Many people never bother replying to the letter. They can't summons all of these people to court so they feed the cars details into the computer to see how many times its come to notice. If its got say 5 or more tickets outstanding they send the details to the enquiries section who will attended the registered keepers address. Any others do not get followed up.

However, she showed me a list of the hundreds of ones where the letter had been sent but there had been no reply. She said they randomly pick 10 a month from the list to prosecute for failure to disclose and the rest just get binned.

HOWEVER, this was a processing unit in London which obvious deals with a shed load every month. This may not be the case in some sleepy little backwater that only deals with a few tickets. They may be able to follow them up because of the much lower numbers.

(Just to clarify, i'm not advocating non disclosure, as I think people should cooperate fully with the authorities and observe the legal requirement to disclose the information. This is posted just to highlight the problems with so many people breaking the law and effectively overloading the system )

 

1 You cannot incriminate yourself this way as the speedo in your car is not accurate enough as evidence IN LAW, that is why the POLICE have CALIBRATED ONES!!.
Even if you had a CALIBRATED SPEEDO, in your own car, and admitted it, there would still be insufficient evidence for a conviction
If you were to tell the cop you don't know whaty speed you were doing as it was off the clock there is nothing he can do, as there is NO EVIDENCE, that a COURT WILL ACCEPT, otherwise you would have every tom dick and harry saying he was doing 45 in a 30.

for a start the old bill give to a fixed penalty,,,, that means theres NO court !!!!

the next thing is to convict a person of a crime you need evidence,,, if you admit you are speeding and theres a copper whos professional opinion ( which IS legal !!!) says your speeding then you get convicted,,, the reason for court is to punish the guilty no look for the loop holes

if you go to court saying about calibrated speedos and the copper said you was doing 140mph as he was at 6krpm in 5th gear and couldnt catch you and you think going to court saying that will get you out of it without a fucking good brief,,,, and even then i doubt someone will win as its not hard to tell a cars speeding when you are flying past all other traffic and covering junctions in record times

You can be prosecuted on the evidence of a policeman on his own with a stopwatch over a known distance
