Default F.A.O. Bank charge people, those who have had success.

I have sent my bank the relevant letters regarding the issue of unlawful charges levied against me. I have detailed the sum I wish to be reimbursed for. I have recieved the response from them "read the terms and conditions etc." But as you are aware On 5 April 2006, the Office of Fair Trading (OFT) concluded that default charges over £12 are automatically presumed to be unfair in terms of the Unfair Terms in Consumer Contract Regulations. Unfair terms are legally unenforceable.

So the only recourse I have is to file small claim at the Sheriff Court, I stay in Glasgow so its different from England and Wales where you can do it all online.

The reason for this post is to find out from people who are at/ or have been at this stage in the past and more imortantly have been successful in recovering these funds.

I understand that no bank has ever successfully contested such actions.

just ignore that crap, and carry on as you were with the claim, I got as far as the courts stage and paid the £120 to file my claim, but they soon paid up and I got the £120 back.

try get a family member or friend in england to let them use the address for mail to be sent to and you dont actually have to stay there as far as i know as its just a mail forwarding address.least that way it lets you do it online

A Forum I use has a section dedecated to reclaiming bank charges.

I have heard of cases in SCOTLAND and where the amount exceeds £750, multiple claims being made & the full amount being recovered that way.

Ive just logged mine with the courts, me and the wife had to do seperate claims as we had 7k between us

Barclays offered me 2k but we are progressing through the courts for the full amount.

so i have left it cos i honestly havent got a clue what to do now,

Not been asked yet Puss but for 7K im willing too I dont think they are asking people to close accounts now but they are making you sign a form stating you are happy to pay all future charges.

halifax crdit card
and cap one crdit card

the full amount on all 3

i dont get it are you all contesting charges like intrest and fees that have been put on your account or are you contesting the amount you owe?

bank charges for bouncing a bill or going over limit ect as they are unjust and too much to be allowed to charge !!!

yeah but they have allready been reduced from 20 to 12 and tbh if you go over you limit shouldnt you get fined as thats why you have a limit? ive had my card from 18 and im 22 now and ive never had a fine or intrest! the way i see it is if i get fined im gonna make sure i dont go over limt again! my mum n dad have had cards since b4 i was born and have never paid fines or intrest either its just managing your account which isnt hard with all the options for paying

realy should pull my finger out!

didn't realise it was credit cards too, I've had probably 10 over the last 6 years, don't know what ones tho and some have been canceled, can I sgtill claim on them???

i keep wanting to do mine but i have a 1500 agreed overdraft with lloyds tsb and i bet they will close my account if i claim and i cant afford to pay 1500 back now.

well i live in ayrshire and I done it all online using my brothers address in london as a mailing address peice of piss it was i got £4500 back in one go, ive never heard of anyone going all the way and not getting paid out.

It doesn't matter, penalty charges are illegal full stop, it has been worked that the most costly thing for a bank is a bounced cheque and it costs them about £4 in admin, bouncing d/d's etc costs them about £2 and they are charging between £25-38 for this, as you say some have reduced it to £12 but this is still more than it costs them so it is a penalty charge which again is illegal
