drivers seat needs to tilt forward incase theres anybody in back and theres a crash.mot failure.

Check strap is the door strap - and the seat not moving forward should be an MOT failure. The view is that the passenger could get in from the opposite side and sit in the back but in the event of speedy access required theres only one escape point.

Drivers seat should not fail providing passenger side is ok.

I agree. If you fix it anyway rather than bodging it it will just make the car that bit better.
