Help in regards to an accident claim against me!!!

Default Help in regards to an accident claim against me!!!

i'm totally fuming!!!!

last month, i tapped a womans bumper at a roundabout in MK. now, when i mean tapped, i mean TAPPED. I was approx. 3inches away from her bumper in traffic. She went to pull away and then stopped straight away. All i did was take my foot off the brake, didn;t even accelrate, and just butted up against her. it was so light that at one point i didn;t think she had noticed. So any expert or not can see that the car could not gain hardly any speed within 3 inches on a virtually flat road....

after screaming at me for 5 minutes..i managed to get her to actually drive off the road as we were causing an obstruction. she then rang her husband and he turned up within 5 minutes. I looked at the damage and there was none apart from the light housing for the numberplate had been pushed out slightly but would not pop back in. I said that there was obvsoiusly something slightly knocked. she then started to say i had scratched both sides of her bumper (how?? when she was at an angle and my bumper caught the middle)...as soon as her husband turned up, she started complaining that her neck started to hurt!!!

anyhow....thats the scene set...

She and i swapped details, etc and that was that.....

She then rang me at 21:15 that night to say that she had gone to a garage for an estimate and she said if i wanted to pay her the £516 + VAT + Courtesy car for the day, i was entitled to do so. I said NO and to go through insurance....she then said that ever since the 'accident' she has been having VERY bad neck aches and MIGRANES!!! i still said...go through insurance!!!

I have now had letters from her insurnace company, my insurance company, the claims dept. company AND her solicitor who want to come round to my house to interview me in regards to the accident, as she is putting a large claim through for personal injurys

her car has NOT been inspected by anyone yet apparently, as they need permission from her solictor first to do so but i have said on numerous occasions that the LACK OF DAMAGE will show the kind of inpact speed

now, this is REALLY PISSING ME OFF!!!!!!! the claims dept. and my insurance company have been brillaint and said that they have to do much more now in regards to this, as to try and falsh-a-fie ( ) her claim.

but she is even claiming that she has been having 'nightmares' since the accident!!!

What do i expect to happen next?!?!?!?!?! as i have never had a claim against me before!!!!

is ANY of this going to hit me in my pocket?? (apart from insurance going up, etc) ????

my mam had a similar incident at a roundabout in 04, my mam and the guy in the other car had two different accounts of what happened, so it ended up in court, and it still hasnt been sorted and its nearly two years down the line.

Let the insurance company sort it, they have people who are employed to route out bogus claimants... and with all this No Win No Fee stuff around these days, sounds like this woman has seen an opportunity to screw some money out of your insurance company.

Worst case scenario is your insurance goes up a bit next year, but as insurance is so competitive these days just shop around for a better quote.


I do think the fact she wont let her car be inspected is well dodgy though, I bet when it finally is inspected it will look nothing like it did on the day of the accident.

I had the same thing happen to me. Only it was in germany and they are Cooooonts for claiming for whiplash and shit like that it was his fault cooont cut me up and slamed his anchors on. i had witnesses saying this aswell yet my insurance still coffed up for some reason on the damage report (it was in german) one thing on the list was glass repair , there was no broken glass what so ever.i only tapped his bumper . Coonts the lot of em

Go round and burn her car. She'll claim on her fire/theft insurance and wont claim on yours


Or you need to "find" a witness. Wasnt there a guy walking down the road that saw the incident?

unfortunately, i didn;t take a photo as i just didn;t think at the time!!! she screamed at me for 5 minutes as she was claiming i had 'fucked' her car!!!

to be honest, it was at the end of the working day, i was being screamed at and just wanted to get out of there (as i could feel my bottom lip start to quiver and didn;t want to lose face!!! )

i DID have three people from work witness it but they did not stop as they admitted next day that they didn;t even think i had actually hit her...just got bloody close!!!

but to be honest....the car didn;t even move when i bumped her!!!

I always thought that the Police had to give crime reference numbers to get anything out of the insurance companies??

She sounds a right bint though. You want to say something about you were shocked at how bad her driving was to force to to suddenly stop, who knows she could've been drunk??? If she's going to take it out of proportion (which it already looks like she has) then you do the same!

This happened to my daughter over a year ago, exactly the same. She tapped the back of the other car with absolutely NO damage to either car and before she knew it she had a claim for all sorts of damage to the other car and whiplash to both the driver and her baby daughter!!!!

this has been dragging on now ever since. The other driver got their own inspection of the car done LOL!!!!

I remember a post quite some time ago with peeps of this board condoning this sort of behaviour well chaps this is the down side

Perfect answer

You might want to add as well after inspection to YOUR car after the damage SHE caused she may want to consider her car to be inspected to deem it in a roadworthy condition!

i had the same thing happen to me, but on the motorway, i tapped the back of someone very gently, they stopped, i drove off as i knew there was no damage. next thing police knocking at my door, they inpected my car, saw it had old stone chips, knew it had not been painted and ive never heard anything since. They asked why didnt you stop, I just said I never hit anything.

stop talking to the women if she keeps phoneing you its classed as harrasement, have you admitted to hitting her?
shouldnt have said a word to her at the scene should have swapped details and drove off. thats all you are required to do.

i had sum muppet jump a red light i went in the side of him he pulled over admitted it and said he would pay cash to get my car sorted and swapped details.. then i spoke to him and he said he was getting onto the insurance company so i contacted my insurance he
said i had hit him from a side turning but i had a witness who just so happened to work for churchill car insurance who helped me with wat to do and stuff told me to stop foneing him or he could have me done for harrasement. i reported to the police straight away then, in the end his insurance company was saying i pulled out on him but the police proscuted him for jumping a red light .

even if her car did roll back onto yours it would be your fault still for being to close.

i would go and take a few photos of her car (non digital camera)
cos if its that bad it must be really fooked to give her whiplash...
develop pics and send to insurance company ...
now if they cant state they have had repairs carried out since the accident can they ...
deffo refuse to speak to her again ..and inform both insurance companys of this...

one thing i learnt ages ago .. always have a disposable camera with you in your car....
had the same sort of thing .. tapped some sales rep at a roundabout about 12 years ago..
left a slight scrape half an inch long... left my details but said it will buff out with some t cut etc let me know ..
next thing i get letters threatening me with all sorts of stuff regarding personal injury's etc ..
developed pics and sent to police explaining he was trying to defraud the insurance company etc also to both insurance companies showing the actual damage concerned ... never heard another thing ....

did you know that whiplash is actually called whiplash associated disorder, as there is no actual recognised condition for the injury, its no different to say a pulled muscle in seriousness usually, and is very very rare, in eastern europe there is no such word for whiplash, and since the whole litigation side of things came out the prevelence for whiplash being claimed has gone up by over 100%

basically, at that speed.. its nigh on impossible to get whiplash, and if she is saying her neck ached that day then thats anotehr reason as whiplash symptoms present themselves the following day...

i had this done to me when i touched the car infront... i found it so upsetting, i understand people saying u might as well get what u can if someone hits u, i think u should just be grateful u werent really hurt and get on with it... enough of this lets sue for everything mentality its depressing

Thats a load of bollocks! She hasn't got a leg to stand on..... Then end of the day I can see the whole claim falling through due to it being fraudulent and it'll be her footing the solicitors costs and court fees (if it goes that far).

one of our drivers got cut up while he was at a set of lights
the guy that hit him was on his own but now 2 people are claiming for whiplash

my mate got hit by a car that was overtaking the guy who was leting him out on a normal road, there were 2 people in the car and then there were 2 peeopl who were interviwed by the police but suddenly there were 5 people who were claiming for whiplash

my case where i was right royaly fucked over by the judge was so clear cut it hsould never have gone to court, let alone seen me losing, but i was hit from behind, and yet the guy has won a claim against me for me driving faster than him AND him seeing me on the slip road that was a full 50 feet higher than the dual carriageway he was on as he was going through the underpass

it all boils down to what you have written down up until this point

have you said that you hit her?
if so you let the insurance deal with it and don't worry about it
if you haven't written down that you have hit her car then you have a case to fight for
even though you say you've boshed her motor a little, there is nothing to say that she wans't rolling back towards you anyway, and if she was looking for a gap then that might explain the crick in her neck as it wasn't braced for the impact when she rolled back into you

if you hit someone from behind you are automatic;y at fault for not leaving enoug of a distance to avoid collision, but whn you are stationary this doesn't count
how would you claim of someone who was reversing their car and hit you while you were parked up?

chips heart is in the right place but you need the witnesses from the other car to give evidence as to what happened
if there isn't a slope then don't say she rolled into you

the second question is that was there any proof of any collision in the first place?
how do you know the dent was caused by your bumper/
what if shed just done it in tesco's where shed been shopping and wanted you to foot the bill?

i used to fill out the claim forms at the bus company i worked for and you can tell by reading them back to people that they are made up

if you have not yet admited to any sort of imp[act, start your statement off with this line, and then fill in the rest as you like:

"I was stationary with my handbrake on when i was aware of an impact to my vehicle............"

I know how you feel Keith. My bro's Cavalier was written off last Wednesday night and despite one of th ewitnesses being an on duty copper and a charge of "Driving Without Due Care" being readied he still isn't admitting liability

The cheek of it really pisses me off!

I had the same in january when i woman in a 206 pulls infornt of me and i lock up and ram into the side of her



As you can see by the picture she was turning and didnt see me, so i hit her rear quarter and spun her on the spot, she tried blaming me, it went on for 3 months until her insurance finally held there hands up and they had to pay £70 a day for my hire car over 3 month, you do the math

Fair play i hate conts like this. Would really piss me off Trouble is when you say you have had wiplash now most people think your just out for some money, because of money grabbing coonts like this. Its not nice having wiplash and even 2+ years after my neck still hurts if stay looking in same position for long time etc.


Mate play the same as she is doing and say she rolled into you, if u havent already said anything.

Agreed, i still have major bach and neck ache, stops me doing some stuff at work and out of work, im still waiting for my physio and for all my trouble ive been offered £1515

She rolled backwards into your car...you swapped details as you were going to ring insurance to claim...then realised your car wasn't sufficiently damaged to warrant the hassle and you didn't really see it as a problem...??

If she hasn't got medical back up for these ''injuries'' shes royally bolloxed anyway...
& Not reporting this incident that caused these ''injuries'' ?!!
& No inspection

If somebody gave me whiplash, (a condition that would prevent me driving home and meaning i might need to go to a&e for some sort of neck brace) I'd be straight down the police station

Don't worry about it...just don't admit to anything

My missus suffered a whiplash injury when our 2i was totalled about years ago. She got a crap payout for genuinely being in and (still suffering) pain. People that pull a fast one always seem to get a nice wedge

exactly mate...who can make up the best tale jobby...The PI festival that is bumps on roundabouts etc...usually the people with the legitimate injuries don't take it as far as those without, they are content with telling the truth..= less payout

unles there is an injury the police won't attend
but if there is an injury then they must attend because they need to get the particulars

so

she claims you have hit her
you have witnesses to say you didn't hit her/she rolled into you/she put it into reverse
you were stationay and had your hand brake on (because it was on a bit of a slope) and (were looking at the sign post because you were) lost and so not aware of any vehicle movements in front of you
there is a witness behind you to back up the claim that you were, in fact, stationary when the third party claims you have collided with her vehicle

with 3 independant witnesses who were there at the time and can proove they were there at the time, this would appear to be an open and shut case of her pulling a fast one

for future reference, never give out your mobile number, always give out the number of the insurance company so you have no comunication with the third party for these simple reasons that thy won't harras you wit shit like this
