Whether its a prisonable offence. Well Grade 5 is. But I believe Grade 1 isnt. So theres clearly some discretion involved.
What amazes me is that Langham used a similar defence to Pete Townsend (The Who Guitarist) and was convicted whereas Townsend wasnt.
Townsend was also "doing reasearch" and to make it worse you still see him around and everyone seems to have forgiven him! (He was on Top Gear when they tested the vans)

Going back to phils point, watching horror films is still fictional phil, child porn is real theres a difference, if you were refering to real life snuff films and people enjoying them then I agree they are just as sick, but fictional gore/horror/murder is not even in the same league as reality and not even worth comparing.
I dont know about the different grades of child porn you mention so I cant really comment, although theres a difference between jailbate that is aware about sex and the reality of it but is just underage, and a "child" who is totally unaware and being abused. how the former cases are dealt with is a mine field as there are a million variables and I think every case should be judged on the evidence not a blanket offence/sentance.
