If you passed your driving test after 1997??? (need to verify date) when the licences changed you can carry upto 3.5t on a normal car licence,
If passed before you can drive a vehicle upto 7.5t.
Vehicles with a MGW of 3.5t or more need to be fitted with a tacho.
So the Vivaro loaded can be driven on a normal car licence with no tacho.
If the guy wasnt taken to a weighbridge, there is no evidence meaning he has no case to answer to,
