Depends who the wally was that set it up. Really they should be set to go off at 45mph (if the limit is 40mph), but you always get some jobsworth who has it spot on 40mph.
Wait for the NIP, If its not there in 14 days, you're off scot free
If it comes, look at the speed read out on the photo (if they include one) If there is no photo, request one.
As for the 10% + 2mph, not really sure about that TBH. I can't see it being right as motorway limits are 70mph, so that would be 77mph + 2mph = 79mph. I know people who have been done at 80mph.
