Wait for the insurance to write it off and make sure you get a courtesy car off her insurance company in the interim.

As soon as she reports it they will sort this, untill they've heard her side of her being stupid they wont wanna know.

If your back or owt hurst sort out some compo.. regardless because your salvage your car and buy a new one with the payout from her policy.
