Default BOLLOX........eventually got the points

Back in october last yr i got caught on the toll bridge by Wales doing 65 in a 50, now i was still on the motorway but as you get to the bridge it's limited to 50 They sent me a letter a month later in november stating that ive been caught and wanted to verify who the driver was, i sent them back a reply immediatly along with a grovolling letter stating i have had a clean licence since day one and that ive never been caught speeding before and due to the nature of my job, would like to escape the points and be placed on one of those driving courses?
So that got sent of and another month goes by and they reply stating they have recieved my info and will look into it
Now this morning i recieved the letter saying they thought about my letter and in this situation are not prepared to do this and are going to give me the points along with 60£ fine.

This has really pissed me off cos ive been waiting 4 months to tell me this and think they've taken the piss Now is there any way in getting them back ie asking for photo prove that i was speeding/prove there camera was calibrated and set to the exact mph etc etc and holding the situation up anymore as they,ve left me daggling for the last few months.....tosser

Any help would be appreciated

If you signed the notice saying you were driving there isn't much you can do as you have admitted you were driving, but if you haven't signed it and only sent a letter, you can ask for the evidence that you were driving, they need two photos to be able to use it as evidence so ask for both.

I tried doing this when I got my points and even took it to court. I'd say just pay the fine and smile and if you were the driver you'll have to pay more in the long run.

You should have wriiten to them stating their failure to notify you in the prescribed time, of their intention to prosecute. If it took them a month they had already run out of time.

Do they have a set time to prosecute the driver as this has gone on for 4 months now and each time ive recieved anything its been on the 28th of the month, minus january when i recieved nout

They have 11 days but they do allow for 3 or 4 days postage from the date of the offence to ask who was driving. If they sent this out after this time they havn't got a leg to stand on.

i thought it was 14 days

ie i got zapped by some cunt in a van on the 3rd nov.

14th nov i get the NIP

send it back straight away and heard nothing since.

im going on the fact that they have 6 months in total to prosecute...

only 2 months to go lol

yer they have 2 weeks to issue the first summons then up to 6 months after that to prosecute i got caught on the same m4 tolls last oct went to court at the begining of febuary and got a 42 day ban they are really clamping down on speeders through there it seems

They have 2 weeks aparently on a speed camera type offence to issue the FIRST contact with the vehicle owner- not the person who comitted the offence. The date of issue must be within 14 days NOT the time you recieve it.

The NIP (notice of intended prosecution) must be made within 6 months.

I am a firm believer of do the crime and pay the fine.

Also worth pointing out your points will be dated from the offence date so by the time you get them on your license they'll only be there for 2 years and 6 months I bet.

yup, I got a notice through the post, for not driving with due care and attention, 5 months and 3 weeks after a small accident I had.

shit your scaring me now. i got caught last october on the fone with no seatbelt, after the fifteen minute bolocking he gave me he said id be getting three points, but havent heard anything since, but then he is an irish paddy copper

probably depends on what their conviction figures are like for that quarter, may need to bump them up a little.

Nothing to do with conviction figures.

4 months sounds about the right turn around time considering you were stalling the process with letters.

May I just add for anybody considering writing in. It makes not one jot of difference EVER. If you want to pull on heart strings to blag your way off....... thats what court is for.

I have been stiched up worse than any of you EVER will, for some offences I have never seen prosecuted before, purely because of where I work and a Police Inspector hates me

the silver lining is that the points go away 3 years after the offence, so you're good portion into that period before you get the points.
Driver improvement scheme costs about £200 if i remember correctly, which is fair enough.

thats not entirely the end of it though,because although their spent after 3 years, their still on your license for 4 years and you have to declare them for 5 years for insurance

with todays camera detector's and sat nav system's it's not that hard to avoid getting caught out IMO

so what happens if you dont use either and the sly cunt in the van is quite well hidden away...?

(not that any camera detectors pick up the vans, well some do but the gov has now kindly made them illegal...)
