Just a quick one, ive gotta take my car nms on saturday, the car is insured but is currently sorned and no mot, nms said there sorting the mot but its not being done on saturday, am i ok to drive or will i end up getting my car took off me like you see on these police prgrams?! My mate can trailer it there, but would prefer to drive it if possible. Cheers

 

Yes - your car can be taken off you and you will get points, plus a fine and possibly the car can be crushed.

Driving to and from a place of MOT test without an MOT is legal. However it is subject to fair use (ie: not an MOT place 50 mile away) and you MUST have valid Road Tax.

If it's SORN'd then it won't have Road Tax and you can't go legally onto the road until you have Road Tax.

If NMS will confirm the MOT if challenged then it's O.K.

It's insured, it won't be taken of you.

 

You can drive it to and from the place of repair, although there is no set distance on this so its a bit of a grey area, but i would say anymore than 5miles and your pushing it. unless these is some special circumstance (specialist ect)

Shouldn't be a problem if nms will back you up if you do get stopped. As long as valid insurance then will be ok.

 

If norris say they have it booked in if you were to get stopped then you are perfectly fine in driving there and back. I know this as Ive done it. Bought cars and got my garage to stick it in the Mot book = Covered As said No limit on distance either. Some people say you have to take the most direct route also but I dont know how true it is. You have insurance so your fine

it should be pointed out that you should check your insurance, not all policies will cover you to drive an non taxed or mot vehicle.

most will state roadworthy, which is fine as long as there are no major defects

Yes not fully correct. It's the journey to the booked MOT and direct return home that can be done. But be warned if the car has any dout as to it being road worthy the police have discression over charges.

 

The problem with this situation is there is a MASSIVE grey area and is open to too much interpretation,
example, you can take your car for a mot and it could fail on a major defect then if you drive it home and the police or vosa see that it definatly has a major defect then you could get done for using it in a dangerous condition. However the law says you can drive "to and from the place of repair" no mention of condition once checked, as in minor defects can be driven away and major defects need to be repaired on site or trailed or even how many miles away your allowed to travel ect ect ect

In the real world it would depend on circumstance and the person you deal with.
If you get a jobs worth and your going long distance in a death trap and tell him you getting it repaired dont be surprised if you end up in trouble.
But if its pre booked and down the road i doubt you would have any trouble.

The cars booked in for a ticket,it's fine to drive.
A mate of mine actually crashed on his way to the Mot centre without t&t and ins company paid out as the car had no major defects without any issues at all.

 

Also no points for driving without Mot,only a fine,only extra points in CONJUNCTION with no insurance.
Yet more bollox,like people who say you have to Mot a car before a VIC check and that you can't tax a car without a logbook or if it hasn't been VIC'ed,all bullshit that I've disproved personally on several occasions.
Another classic is you have to re-Mot a car after it's been written off,total shit.

Borrowing Trade plates (Trade licence) is pointless as well, even if someone was daft enought to lend them.
You still need a an MOT to use them legally, unless you're going to a pre booked MOT and return, which is the same exemption allowed to anyone.
They just cover you for no Tax.

i got caught by dvla camera car thingy driving my saph to the garage that was setting it up and mot'ing it, fine came through the door for having no tax, quick letter back to them explaining the situation with a copy of the mot cert and job was jobbed.

also for folks saying borrow some trade plates.........you do realise trade plates only exempt you from having tax on a vehicle?

 

Where is your information from? Unless it's a new rule there is no distance limit. I asked VOSA to clarify this at the end of last year, and they confirmed there is no distance limit.

I took my car to VOSA for its SVA test with no tax, no test, no registration plates. Didn't even a registration number to put on a poster in the window.

When I left the test-centre the cops joined the road at the roundabout and were in front of me for a good part of the journey and they didn't bat an eyelid. Guess they are used to seeing all sorts of vehicles going in and out of there.

And there is NO limit on the distance you can travel to an MOT either.

You can live in scotland and legally drive your untaxed and un-MOT'd car to a MOT station and back from a prebooked MOT.

 

I spoke to the DVLA about it for something I was writing for total vauxhall mag and they confirmed to me in writing that there is NO distance limit and also no restriction on the type of roads used, ie you can go on motorways etc too if you wish.
