Default is my car a write off GUTTED (pics inc) UPDATE page2

I think it is, slight kink in roof, doors don't shut properly, cross member bent etc etc...Bird pulled a U turn with no indication gave me no chance but she is disputing it which makes my blood boil.
Only had the car 2 month's after a long time saving and was meant to be going to the surrey meet tonight.

Looks like a right off to my untrained eye. Hope you got plenty of witnesses so she can't wriggle out of it.

Where abouts did you hit her car i.e. in the rear, in the side etc. The position that you hit her may give the police/insurance company an idea of the manouvre she was carrying out at the time.

Yeah its totally gutting..it happened outside the womans house and the neighbours said my car was very noisy so obviously i was speeding. Police fella said from the position of the cars he could tell it wasn't my fault even though that was off record.
Air bag smacked me in the kisser which fooked me right off and can't get a hire car till liabillity has been accepted.

Will i have the option of keeping the car? ie so i can sell the nice bits off etc.

depends on your insurance company tbh there is no set rule to if you can keep the car or not just keep refusing offers then except one with the option of keeping the car worked for me

I do not see how she could even win that if she tried she pulled OUT into your path therefore her fault by default.

That is a write off unfortunately mate

That cars got a lot of nice bits on it, so if cheap enough, it would definitely be worth buying to break... sorry to see it in that state though. Main thing is you're alright, these old Imprezas aren't known to stand up well in accidents.

Cheers,
Grant

Hate to be the bearer of bad news but in the eyes of the law you should have been traveling at a speed you could have stopped. It's stupid but it's the way these work, make sure you can prove she was doing an ilegal manover, and make sure you claim for injurys from the stupid bitch

Well she's openly admitted she was doing a U turn etc so i thought that would put me in the right. I thought it would be like someone pulling out on you from a side turning etc.
Anyone else have any opinions on fault?

As an insurance engineer I disagree, if he was doing 10 mph and she pulled straight out and he hit her would he have been going to fast to stop??

If she has crossed yr path when you are travelling down the main road without making sure she is clear to make her manouver then she is at fault.

I don't think that's the case, as when someone pulled out on me she told the Police I had been speeding who told her it made no difference. They said something along the lines of 'It could have been a Police car on call'. Needless to say whether I was or wasn't speeding never even came into it.

nodubnorub if everyone drove at a speed where they could always avoid people pulling out then youd have to stay stationary

This is why we have give way lines, rules for pulling out etc.

.....since you mention it, I could be interested in the rear lights if/when its being broken.

Sorry to be a vulture, but just registering interest.

the police often know very little about the law as has been proven on many times

Mark4, these things can be very quick or it can takes months and months of aggro. The more hassle she gives the longer it will take,

Common sense would say that if she pulled from side of road into path of traffic without looking or indicating then its her fault. Its also clearly against the highway code and probably some RTA/council law somewhere.

Exactly, that's why in my earlier post i asked where in relation to her car he hit her. If it was in the side then i think you should be ok but if you went up her arse (figuratively speaking not literally) then there would be a good chance you would lose the claim as you should be far enough behind to be able to stop suddenly.

my car hit hers on the front drivers wing, the collision happened on the wrong side of the road as i had swerved to avoid her as there was no chance to stop without contact, she kept coming across the road into my path......she pulled into the gap i was using to go round her on the wrong side if that makes sense.

Gutted that the car has been written off Hopefully the parts can be saved or it can be reshelled. My mate has just sold a 2000 shell for £700 that was pretty mint so it's possible.
