Need some advice...

Right basically at the weekend mine and my housemates mate got really drunk and came back to ours and started getting very agressive and took a swing at my mate
subsequently my housemate in self defence smacked him around a bit my mate then decided he wanted to stab my mate and again my housemate knocked him out (about 5 times this happened)
he then got thrown out of our place and jumped in his car got stopped and was caught drink driving (reading of 82)
from rumours i hear our mate had also took a couple of pills.
when he got arrested he played the i just been beat up card and know my housemate has been bailed orignally for GBH but put down to affray.
our "mate" has said hes going to withdraw his statem,ent but the police have said that they are still going to try and charge him.
can they do this?
if so its not looking good for him as i think it maybe a jail term!

it's a bit unclear though so is this anything like it?

who got agressive with who? one of your housemates?
so the weakling gets a blade and get's knocked out?
and then gets knocked out again
then jumps on someones car
then gets done for drink driving?
depending on who the judge believes, and this will come down to a judge if things go on, your mate who landed the blows could be in deeper deep shit than mr drunk driver
he can turn around and say he was defending himself and, for fear of his own life, he drove away as he couldn't defend himself because he was pissed
it's a bit of a sticky situation as well because you can't really go round asking for "advice" on a forum as it might be benificial/prejidicual to the case in question

Somehow I doubt that you will no longer refer to him as this!!! 


Sounds like a proper cunt - repeatedly kickin off, getting pulled for DD and then to top it off trying to blame someone for his stupid actions.

yeh basically the our mate come round got agressive and smacked my housemate.
told him to get out for about half an hour then he swung for my housemate again so my mate nocked him out. the guy gets up goes at my housemate again, housemate nocks him out again. mate gets up and goes to the draw for a knife, went on for about half hour before our mate left and jumped in his car and got done for DD
there were witnesses there (our mates girlfriend and her friend) who basically said to my housemate he gave him plenty of chances (it started over our mate being nasty to the 2 girls first then started on my housemate.
hes playing the "i am a victim" card at the minute.
hes dragged me into all this (i was away for the weekend) but i know what our mate is like as he tried to do the same with me b4 but obviously didnt go as far as he went to sleep.
i've even tried to help our "mate" by tellin him he shud go on an AA course and stuff but after all this hes just a selfish tosser!!

thing is the courts wont let him get away with drink driving. His life was not in danger and he wasnt being chased on foot so he could easily have run/staggered away rather than driven. Even if his life was in danger he would still be convicted as he WAS drink driving but the mitigation might reduce sentance.
Yes he can still be charged even though the "victim" has withdrawn his statement. Big pressure on the Police at the mo to cut violent crime and be seen actually putting people before the courts (although its the Cps who decide this now)...its all down to the CPS these days. If they feel like they can secure a conviction then they will run with it.
