Default Pothole tyre burst advice. . .

Burst the tyre hitting a pothole the other day. Got a new one fitted now (£68) and thought that getting the council to pay would be too much hastle, pics of the hole, letters to them, phone calls etc. A lad my lass knows, came in to the petrol station where she works and said same has happened to him. He went to the highways office (or somewhere), ranted a bit and they said "Fine, we'll pay". Is it really as easy as that ? What's your experience guys ? cheeRS

Unless they're aware of it don't think you get anywhere.
What you need to do is report the hole, then have the damage happen.

mate of mine in the firebrigade phoned up to moan about a 2mile stretch of road near his house so they repaired the road here n there(took about two weeks)then phoned him to see if it was satisfactory,,he said no so they resurfaced the entire road

all because he bought new rims for his cav turbo

not quite the same but......

Fife Council told me to piss off after I hit a half-bag of concrete they had left to go off on the side of the road after an earlier repair.

Killed the front alloy and both nearside tyres.

Edinburgh did the same after I hit a kerbstone and killed two wheels and two tyres. Said it had never happened before despite all the gouges in the kerb, but still repaired the whole junction in less than two weeks.

Then the Freedom of Information legislation came in and they had to admit to TWELVE similar incidents, including a motor-bicyclist who ended up in hospital because of the same bit of kerb.

They still didn't pay, though!

I hit a pot hole filled with rain about 3 years ago in hemel, it cracked the alloy and damaged the tyre. I had to take pictures of the hole, pictures of the wheel etc, sent the letter off and got a cheque back in under a month.

They didn't query anything about it and just posted the cheque.

These are the pics I sent them:

Good luck with your claim

if you do as amberp has done with the pictures
you should get a pay out. legal term iirc is an
"unisured loss" but i have heard many of
unsuccesful claims where the councils gets
out by saying they was not aware of the hole.
there must be a time scale in which they
have to act, so if you inform them by recorded
delivery of the hole and its not repaired within
a few weeks hit them with the damage bill.
you could try this too.

I hit a kerb stone in a car park at night there were other bits like it in the car which had cones round it but this one didnt, i hit it n bent my subframe where the lower arm bolts on and the seat belt pretensioner went off! cost me £100 for new seatbelt but lucky the subframe wernt to bad so we just bent it back abit. I did think about claiming but i knew full well it wernt even worth the hassle.
