Default insurance claim info - anywhere i can find out what..

cost bracket injurys are put in?

some will remember i was hit off my motorbike in july by a woman performing an illegal right turn - she was done for careless driving as a result

my injurys were sore bollocks for 2 weeks, strain/bruising to inner thighs, fooked wrist (not broken), fooked back and neck (again not broken)

i basically went over the handle bars head first into the side of the car... at about 40mph...

i was taken to hospital and had xrays on neck and back etc, received pain killers etc

my solicitors have said to decline the offer as 'it is below the bracket of damages that we would expect to be awarded in court'

they also want to know if i am still suffering any sypmtoms, and i still get a bad back/neck

and fiinally, as a result of this non fault accident, my insurance has gone up by an average of £180 for the few online quotes that i have done (both by submitting the claim and not) so can i claim for these premium increases for the next 5 years too? as thats how long they ask on your insurance!

any input from the legal beagles would be muchly appreciated

i had simular injurys n a bike,
i got 8k so i think anywhere from 6-10k mate.

Just be aware that if you go to court and lose, you pay all the expenses!!
You lose if the judge awards you just one penny less than was offered.
I took the MIB to court in Bury St. Edmunds, about 3 years ago, and won, the legal expenses for the MIB were £24,000, as they hire VERY expensive solicitors, from Liverpool!!

i wouldnt be too hopefull

my ex was in a horiific car accident after being cut out of the car she ended up in hospital over night, bruises and back/neck pain

she couldnt work for a month, due to not being able to move properly, had to have weeks of physiotherapy (at her expense) and still suffers the occasional twitch and pain from her neck

she only got just under £3k and that was fighting the case for well over 18 months

they can be real tight on compensation claims nowadays, i'm not a lawyer, just thought i'd offer some experience with dealing with these things.

i dealt with Irwin Mitchel solicitors when I had my non fault accident in my mums KA before I got my saph and I got approx £2200 for my shoulder injury but it took about 9 months to settle cos no-one wanted to be a witness and she didnt accept liability - bitch!

as long as there are no inconsistencies in your story you should be ok and as long as your insurance company are fully behind you!!

i had 3 very good witness', the car behind, the car behind that one, and the car behind that one...

i was passing a line of stationry traffic when she decided to make an illegal right turn into a housing estate.

would have been ok if i wasnt about 4 cars away...

she admitted she didnt look in her mirror/blind spot to myself and the cops.

not a bike accident but a car one i was in, i suffered a laceration (sp) to my right ear, whiplash, 3months trouble walking etc. (passenger in a mk3 fiesta, side inpact) and 18months later i was awarded 8k, declined the first offer then got 9.5k for the second (worth it for 6 weeks waiting).

As my sister works in insurance she told me to decline the first offer. this works in most cases, she also told me the company she works for has a limit to work to, she told me she will always offer the lowest amount, also she said in most cases ie around the 10k mark the first offer is around 1-2k short of what the claim is worth,

i depends how long you suffered for:

i.e. whiplash
Recovery within a month >£1000
recovery within 6 months >£2000

surely your claim will be reduced as you shouldn't be overtaking a line of stationary traffic.
the law doesn't differentiate between a bike and car doing this.

eg if a car overtook like you did everyone in the queue would be up in arms..

not having a go btw hope you get enough to finish the sierra!!!

on a bike its called filtering, its not illegal like most seem to think!

yes, peeps in cars sit there saying 'look at that cunt, i wish i had a bike!' etc

and yes in a car they would just call you a cunt

the fact is, i was on the opposite side of the road, not almost clipping the wing mirrors of the cars i was passing, the opposing carrageway was TOTALLY clear

and the cops attended the scene, not once did they say i shouldnt have been doing what i was.

and finally, i hope i do get enough to finish the 3dr, its already booked into pro-alloy

Bare in mind your solicitors make money by going to court, so they arent exactly unbiased.

It may not be illegal neither is running out in front of a train, but doing things like this can get you hurt can't they ?
So if you end up in a wheelchair paralysed from the neck down when filtering goes wrong, you can say yes love but at least I was right, must be a hell of a consolation.

There doesnt seem to be any pattern to follow with injury claims, my gran recived £2400 after slipping on baby food in Boots but them my Grandad only recived £1200 for whiplash after a van drove into the back off him at a st of lights which were red at the time. My gran only hurt her knee yet my Grandad needed physio for his neck. Fooking strange claims system we have over here
