Default Help needed RE parts damaged in transit

I sent some parts to a lad off xrtwo.com.

It was discs, caliopers, a complete xr2 suspension kit, and 4 escort GTi alloys.

I used amtrak. Now he tells me they been delivered but the box has been opened and one disc, plus the complete rear suspension is missing, plus the 4 wheels have been chipped/scuffed........

Amtrak have basically told me that as he's accepted the goods, they can't validate a claim. Now, I need to know where we, me and him, stand.

If I can't get anything from amtrak, I will re-imburse him some of his money, only fair IMO, but I'd like to be able to get something from amtrak as it's THEM who has opened one of the boxes and lost half the stuff......

Help please.

i wouldnt pay out anything. he accepted it was his own fault for not checking the parcel. it should be him taking it up with amtrak. and they have already said the rules

end of the day YOU have done nothing wrong

why is he trying it on then?parcel companies are staffed by fooking wankers that dont give two shits about your parcels,we deal with it day in day out,i bet 100% its the couriers at fault, sue the bastards in the small claims, they fob folk off far to much.

Simple fact as we use couriers all the time at work and receive stuff in all the time if you sign it with just your name then your fucked as a signiture means all is well if the boxes were damaged he should hasve sign saying so thenm a claim would be valid

at work whenever we receive something we sign it uncheacked /damaged that way we are covered

Thats the problem. He has signed for them, meaning the parcel company won't honour a claim as they say he could have damaged them himself.......

If I ever sell anything again it'll be fucking collection only

To be fair Rab,

How did he not notice the open'd box?
was it him that signed for it, or someone else, that wouldn't of looked twice at it before signing for it?

i always either check it first, or sign unchecked.
