Default MOT failures and arch rubbing?

If your wheels rub on full lock on the inner arches is this an MOT failure?

the filth stop checked me and took my car off the road for tyre rub....


fucking cunts,....


the thing is though,...it was a series 1 with standard wheels and tyres, and standard ride height,....


had to have to towed to an mot station who passed it saying they wernt rubbing
