Default .:Traffic Warden SCUM!!!:.

Parked my car in the station car park 'season ticket holders' area yesterday which is allowed after 9:30am, I made it about 9:35 so I bought a ticket and came back to find a £70 fine!! Turns out the machine made it 9:29.251secs...

Un-fucking-believable...£70 for being 30secs to early??? Now what do I do, part of me says 'well, the rule is not before half nine and I did so tough' but on the other hand what a petty jumped-up little fart to give me a sodding ticket!!!

Opinions? should I fight it!!

All you have to do is contest the time printed on the ticket. Ask when and how the machine was last calibrated and from which source. They will definately cancel that ticket if you contest it.

sabres74 You think? As Sassy said most people wouldn't bother as after 14 days you can no longer just pay half and whats the betting they wouldn't reply before that time!!

Rolls Of course, I stopped by the machine on my way to the spot!

A couple of things:

Does the ticket machine have a clock on it, could you have been expected to see that the time was before 09:30?

If the ticket was issued at 09:29:25, then unless you were parked next to the machine there is no way you could have got to the car and put the ticket in before 09:30,

Unfortunately the other side to that is you must have actually parked before 09:29:25 to be able to get to the machine at that time, Or did you park elsewhere, buy the ticket and then park?

I think it's worth appealing.

b***er too late.

Yeah it does have a clock unfortunately but since I didn't leave my house till nearly half past I didn't even look

Good point about the parking time though, I did stop next to the machine, got my ticket, and then went and parked so there is no way they could say I actually parked before half-nine!!

Another Key thought,

Is it an offence to park before 09:30 or is an offence to display a parking ticket dated and timed before 09:30

I believe it's the first one, read and photograph the conditions on the ticket and the display by the machine, then appeal.

Unless that ticket machine has been synchronised and calibrated within the last 24 hours then you will get the ticket cancelled. They cannot prove the time was correct to that accuracy. I used to know someone who worked for the department that dealt with parking ticket complaints.

you got the ticket before 9:30 though ..cant contest that you parked after you got the ticket ..

deffo contest it though .. always worth the fight .. they might let you off but remember they always have a clock on the machine .. its not their fault you didn't look

to be honest the warden was just being a bit over zealous .. just do a nice polite factual to the point letter and i'm sure that they will see that it wasn't like you were trying to gain anything by going there 35 seconds early
set your watch by teletext or summit take a foto then go to the machine and check the time on their display compared to your watch

contest it and you will not have to pay end of storey

the traffic wardens watches have to be time checked everyday to make a ticket issue valid, as a result so should the machines but there not and its a fact that most digital watches loose almost 1 second a week, some more

as a most pay and display fines are not allowed to be issued untill the ticket has expired by 4 mins

your situation is different BUT the same rules apply

i got done for entering the congestion charge at 18:29 and 52 seconds ages ago

i got the fine through and i called em and they said i ahve to pay even though its petty i still have to pay or face legal action

i decided that im not even gonna bother writing to appeal against it as they can just take me to court,,,,,,, i recived a 100 quid fine 14 days later, then 150 quid a month later or it goes court,,,,,,,,, heard nothing after that so i guess it went court and was thrown out as it was 8 seconds to early

for you i sugest writing in and then it gets scrapped

dont forget to buy me a drink for the advice though

Oh no!

Seeing that reminds me i had a similar thing last month but over 5minutes rather than 30 seconds.

Mad me mad and I wrote a very offensive letter telling them to stick thier parking ticket up thier ass and you wont get te money even over my dead body.

Looking back that was pretty stupid. Will i get away with just sending the money off or have i "burnt my bridges" properly??

06 offence im sure is either not clearly displayed ticket or ticket expired, its been a while since i was a traffic warden

think its not clearly displayed though and 04 and is expired meter and 05 is p&d meter expired

so unless its that then your fine

at what point did you find the ticket on your car?
when you came back after getting the ticket or when you came back after going away and returning to move the car?
if it's after you went to get the ticket you are fooked
if it was after you retuirned from your day away then fight it all the way

but i agree with the majority here that the warden must have been taking the right proper piss

I assume codes are the same Nationally,

Then:

06: On street- Parked without clearly displaying a valid pay & display ticket**

( ** Or "voucher")

Going back to my earlier statement, it appears the penalty is failing to display a Valid ticket as it is timed too early.
Not parking too early.

On that basis your stuffed, but at £70, it's still worth fighting.

If it wasn't till nearly half past that you left and then you arrived at 09 35 why the hell do you drive there?

Is it really that far or worth it?

On this ticket it says,

6. Parking in any area restricted for use of season ticket holders without displaying a valid season ticket.

That's good then:

At the time the ticket was issued, 14:24, there were no restrictions regarding parking and season ticket holders only. (I take it you've parked there before with no problems?)

Not guilty of the offence that you are accused of,,Case dismissed...

It's irrelevant that the ticket was issued too early.

"Voucher" in the list of codes is probably interpreted as Season ticket where it applies.

Cant see from your photo but all parking tickets must have two dates on them, one of the time of the offence and one when the ticket was issued.

If not then the ticket is invalid

Thats what I was thinking.

My mate lives in Islington and has a traffic warden office in his street. They patrol from 8.30am on the dot to catch any non permit parkers out. My other mate who drove us up there was stung for Saturday parking as we arrived at 1.15pm and free parking on Saturdays is from 1.30pm.

Also with trains, don't the cheap fares start from 9.30am? If so they would be out in force regularly for anyone trying to get as close to that as possible.

If you saw the time on the machine as 9.29am, why not wait until 9.30/9.31am on the machine, then by the time you walked back and found the ticket, you would have more of a leg to stand on.

Worth contesting and a pain in the arse but it is his job.
