surely if the car is a total loss and the seller hasn't disclosed this then by law you are entitled to your money back.
I bought my first car back in 87, the police pulled me over and asked if I'd known it was a write off. I said no. They gave me the proof, I took it back to the private seller 3 weeks after I bought it with a letter from the police. He refunded me my money.
