Default 2003 Fiesta semi-auto box problem *P0810 clutch position fault*

I have a 2003 1.4 16v fiesta with a semi-auto gear box (manual box with electronic clutch/gear change)

i have no idea what happened, it got taken in p/x as it is.

The car wont start, there is an orange warning light on the dash. it stays on when not in the N position and foot not on the brake. when N is selected and foot is on brake, it flashes but wont start.

when the gear stick is moed out of N, it jumps between 2 and 4, so it doesnt know what gear its in.

I have put power to the starter motor and the car started fine.

i scanned the transmission with Launch, and it came up with CLUTCH POSITION FAULT - P0810

I searched google for the fault and the only answer i found was that someone had exactly the same problem, they replaced the clutch, and reset it on the scanner and it cured their problem. before i buy a clutch kit, has anyone had any problems with this before??
