The Road Vehicles (Construction and Use) (Amendment) (No. 4) Regulations 2003 defines a person as "driving" even if the vehicle is stationary but the engine is running.

So just tell the magistrate that you parked illegally and were causing an obstruction and that as you did so it consituted driving without due care and attention so you can get more points and a bigger fine
