capability to consent is an important part of rape laws. The law does actually place responsibility on you in such cases to ensure the other party is capable of giving consent. Its a complicated part of the law but is designed to protect people in cases of date rape etc. Otherwise in date rape you could argue in defence that she didnt say no and therefore get off the charge on reasonable doubt. The law does not care if the drug in question is alcohol or rohypnol or anything. Its similar approach with vulnerable people, people with learning disabilities etc as well as underage sex.
