So long as you know who you are insured with, plod are legally obliged to check, they cannot legally tow without checking with insurer first, but I know they do.
You can claim any charges back through the county court via a summons for errors that lead you to incur expense, that's a legal right, it's not your job to check thier work.
I just had £104.40p from Norfolk Police for thier error, put simply they were offered through Crown Court Judge Judge HHJ HOLT the option of paying or meet me in court, 1 week later a cheque arrived.
Mt gf's car is still reg as unlicensed/untaxed on DVLA, even though it was taxed in APRIL 09, at a DVLA office!!

if you can not prove you have insurance they DO have to take the vehicle away just incase you kill someone later on, it sucks but its there for a reason,, the bit that fucks me off is a genuine error and you still have to pay the fine unless the insurance company have no way of passing the buck onto you,,, i know this as i have been there !
