Ebay has got to big for its boots, and sooner or later someone is going to take them to court over this reimbursement method. I think it should be down to a small claims court to decide who should be reimbursed, if the seller thinks something dodgy going on then he or she should have the right to refuse the reimbursement. ebay are not judge and jury. trouble is, i'd love to say sod ya then and end my account but where else can you auction things off to the whole world.
There is nothing when you bid on something on ebay to say:
"By entering this bid I agree to the terms stated in the advert by the seller"
So if you took them to court you might get somewhere, but a court would then have to decide if bidding on an item (which already has terms implied) constitutes the buyer signing up to demands within the auction or not, as like I have just mentioned, there is nothing on ebay that states that they agree to do so.
Possibly if you sent a message before shipping the item asking them to confirm that they are happy with those terms that they respond to it might have more chance of being legally binding.
