Hi Bournemouth,

Sorry to hear about your predicament buddy.

If the guy had carried out a hit & run, it's likely that the Insurer of the guy that he ran into would have ran a Motor Insurers Database search to look for current Insurance policies, found yours and directed the claim to your Insurer as a result of this.

What you will need to do is contact your own Insurer and if possible the Insurer of
the guy making the claim from you to apprise them of the situation.

To neaten things up, it would be prudent to forward them a copy of the sale slip showing the date the vehicle was sold, along with anything you have to support the sale of the vehicle (ie. copy of sale receipt or even a copy bank statement paying the cash in for the sale).

Clearly the police could back you up if required and this would also be worth pointing out to all concerned.

I quite understand that you would have left your prior car open as you were "searching for another car", which is what you need to inform your Insurer.

The best starting point would be to contact both Insurers to obtain specific contact details of claims handlers and references.

Then sit down and draft a letter outlining the situation, with supporting evidence and requesting their comments as to your enclosure.

Send this by special delivery and follow up if you havent heard within 2 weeks by checking to make sure they received the letter, then advise that they are falsely damaging your reputation/record and request written confirmation from the other side that they will cease action against you.

This can be passed to your own Insurer to get them to close their file on the claim, unless your Insurer is satisfied & can delete the claim from your record with them this may still show up on your record (albeit with zero costs) even though closed.

You can pretty much sort this situation out but courtesy of matey it will be a bit onerous in the short term.
