blatently trying it on, I would wager there are a fair few people running cars on tyres WELL over 5 years old, if not 10..... He is obviously a scammer, either full refund and return of goods, or he keeps them, tell him to get fucked.... Personally I would take a few mates and go and pay him a little visit
