Well they cant fail you for no spare wheel or no seats if you take them out so I fail to see why you'd get failed on an ARB that was taken off

Nothing i have said is wrong :s apart from the fact the ARB is explicitly mentioned in the manual which i didnt know!!!!!

My point about the spare wheel and seats still stands correct.

You can pass woth no spare wheel yet fail with a bald spare

I once removed the rear seats from a car to pass the MOT as the rear seatbelt inertia reel was fooked, so before I took it to test station off came the seat and the bits the belt clips into and hey ho a pass. You arent obliged to test something that isnt there unless explicitly stated in the manual. ( like ARB's )
