a private seller by law is NOT required to disclose it's on the hpi list, so the bloke hasnt actually lied has he by not saying anything, he's NOT implied to tell you unless you ask him, whereas a trader has to tell you in the description.

You should have HPI'd it before clicking Buy It Now or seriously bidding on it.
