I don't own an M5 (yet ) but here's a thread I started a few months ago that tells you about a few things to look for.

-Aim for buying a facelift car, and if possible one registered before march 2001, you will get cheaper road tax, best of both worlds.
-Vanos issues are rare, most of the old wives tales are simple vanos issues that resulted in the units being changed out unnecessarily just because they were under warranty, later cars (facelift) have a non return valve for the oil in the vanos so the oil pressure builds up quickly on startup
-Every car will sound rattly on startup, this should go away after 2 seconds or there about, some people give you awful looks when they hear the noise it makes on a cold day when you turn the key, it's nothing to panic about, after an instant it should be smooth.
-Rear diff seals are very prone to leaking
-Gearboxes are commonly notchy from cold on higher milage cars, always goes away when warmed up, you cannot get the boxes rebuilt easily, BMW do not sell parts for this.
-Brakes arent the best, but don't buy uprated discs uness it's an aftermarket brake kit, the BMW discs are the best standard sized discs you will get, so stick in some better fluid and uprated lines/pads as well as front brake ducts to assist cooling.
-Average about 19-20mpg in mine as a daily
-Pixels inn dash display commonly degrade and become unreadable, can be fixed for about £140 if you send it away
-Brilliant in the snow with a proper set of winter tyres
-MUST be run on Castrol EDGE TWS oil that states *for M series engines, I would not buy one that has not been serviced and maintained by a non-specific BMW specialist, only main dealer and inpependant BMW garages.
-It's generally accepted that most M5's use oil, its is rare to find one that doesn't, so you need to check it regularlky and always have a supply of oil handy in the garage. it is not uncommon for some cars to use as much as 1L/1k miles, however this is at the higher end of trhe scale.
-Had mine for ages and I'm pretty adapt at getting good deals on parts, i only use genuine BMW bits, the quality is excellent unlike the aftermarket crap you get on eBay
-Send me a pm if you need any additional info

I concur with Rog 100%.
Am seriously considering selling mine lately but the price they fetch puts me off as I have spent £1000s on mine in the last could of years with new suspension, bushes, brakes, balljoints, the bloody works. now its 2012 it seems my reg plate is worth more than the fucking car. LOL

Cheers, I agree with Stu actually, I'm not a big fan of the E60, that's not to say it isn't a nice car but definitely not my thing. Fuel economy is absolutely dire just for starters.
I want to sell mine (purely for age and mileage) but I haven't found anything else I like that is similar in quality and capability so I'm going to hang into it till spring, it's worth bugger all now so I won't lose much on it other than fuel costs obviously.
Lately I have been looking at Alpina D3's (the newer twin turbo diesel one) and I think it will be one of those, once I get the taxman off my back...ahem ahem

Too many posts.. I need a life!!
I don't think the prices for a decent mileage e60 will drop much more, the cheaper ones tend to be 60k plus miles as the mondial warranty rockets after that mileage.
E39 just looks mega dated imo. I use the e60 as a daily and average 18mpg, and in full auto mode to work and it seems fine at low speeds, deffo no worse than my old e46 m3.
The only real issues I have is the fuel tank is to small, and possibly it's to fast for most roads. Seems as soon as you touch the throttle you are over 100mph which is asking for trouble.

Agree E39 looks dated now.
Im actually on the look out for a E60 M5, really fancy one.
started doing my research in regards to the BMW/mondial warranty, what sort of price are we looking at at post 60k mile cars?
How do you find it it to live with. whats the SMG system like? I have read the pump where a problem on pre 56 plate cars.
