hopefully jumping the gun but..

im lookin at a gross misconduct at work for going on a roof without safety gear (sky fitter)

wondering what the script is with reference to benefit and shite like that

theres no real findable info on net

im unsure if theres an amount of time i cant claim etc etc, got bills so looking pretty fukt

what sort of safty gear you expected to wear mate ? im a self employed builder and we ve had loads of sky / ariel fitters round to our jobs and never seen any of them with safty gear

Any safety gear that a "reasonable" employer provides to comply with any/all H&S regualations MUST be worn at all appropriate times

ie no need to wear a harness stood on the floor but must be worn PRIOR to climbing on a roof

if the roof is VERY low ie 3-4ft you could claim that you made an on the spot RISK ASSESSMENT and decided it was not required ( low risk is for VERY low heights )


If none of the above applies you WILL/SHOULD be dismissed for GROSS MISCONDUCT as breaching or failing to follow H&S instructions or practice is Gross Misconduct in pretty much EVERY business..

The only defence you may have is if you can show that other people have done the smae thng in the past and either got away with it or been disciplined but not dismissed. This argument is called "common practice"

Bear iin mind you may well be getting others in the shit too


In the light of you being dismissed the following in generally the case

1. You will recieve NO NOTICE payments at all and be dismissed with immediate effect
2. YOU Must receive any untaken holdiay payments as they are your RIGHT and not a benefit
3. Any expenses that you have incureed to complete your role up and until your dismissal again must be paid in full

i did sky for 3 years, as a sub contractor, we always had lads joining who were ex sky employees that got sacked for this. sky are strict when it comes to HnS. Loads of contractors will take you on if you want it.

basically i climed on a bungalow roof

i had previously used all my gear and had packed away but forgot to move a clip on the dish so walked up the roof just as my regional manager pulled up and saw me

i work for a sky business partner so not sky direct



thinkng if it goes to shit i could go it alone doing ariels etc, not done them myself but plenty of the guys do on the side but im not sure where to start

the same day 2 others will be going for similar things, 1 not using safety gear and the other leaving a customer on a 3 story roof without a ladder after an arguement

the other guy who dint use his gear has been caught twice previously so im unsure what will go down

in the short term i dont know if i can get my rent etc paid while things get straight?

do you think there is an arguement for my sanctions that would restore faith?

im thinking photos of every job, contact to manager if roof work is required etc?

Well why don't you go try and appologise? Tell them it was a grave error of judgment and it won't ever happen again,then start with the "needing a job because of " add reasons after.

If you think you're gonna get sacked then you have nothing to lose.

You need to take all evidence of others etc with you to your hearing

You also need to try and get "mitigation" ready

So high quality work might help but much better to go in VERY humble and admit to a grave judgement error although the risks where low you fully understand and are willing to undertake whatever support or training as appropriate

Also dismissal can sometimes be avoided with a FINAL written warning

This basically means that they are willing to give you another chance but fuck that up and your toast

If you are CERTAIN to get sacked, then you need to resign before you get fired. That way you can still get a good reference etc...

thats a myth mate, i quit my job a few years ago and didnt bother to sign on cause of this but 6 weeks into it i had to sort something out and i felt i was entitled anyway,,, went in there ready for a argument to get money cause i have a kid and a missus,,,, no need they just put me on job seekers and told me what i had to do and i should have came in straight away as they cant backdate it

I got sacked for misconduct back in september last year. 4months into the jobseekers claim they put a sanction on my claim, no money for 6months which they then reduced to 4months. I got the chance to put my side of the story across, but was a waste of time, what the company says goes. There's ways around the sanction, like hardship payments, or goin on the sick while the sanction is running. Forget appealing against a sanction, done that 4months ago, and still waiting to hear whats happening about it.

Not actuallly factual

If you resign during a disciplinary process your employer (current) has the following options


1. Accept it and say bye
2. Accept and during your contracted notice period carry on the investigation and any action and this can be done with you present or not (your choice)
3. Refuse it due to the active investigation and carry on etc
4. Accept it you think nothing more and your reference could (should) say Dates of employment , Job title and salary at leaving . This is the WORST reference you can give and to be fair get

YOU have to give details of the occasions this other guy has done this and no action taken

However

You will need to sure that the regional manager was aware and took no action or they can simply say ( and i would)

this is my intention

ill give it the large, ive spoken to a few others that have been in for this and im 50/50 which is better than nowt

its a bit like speeding i think, it happens and you never really think but you get a ban and you straighten up huh

at least for a little while in speedings case but if you then got done again and never were allowed to drive again damn straight you'd never go over 20

fingers are twisted

well i got the bullet
zero tolerance on roof issues

strangly it seems the guy who caught me is advising me to appeal so im guessing that his hands were tied but it may be sortable on appeal

ie his end is closed but reinstatment is possible if i speak to the guy 1 step higher

ill give it a whack

either way anybody out there info ariels etc, thinking of going alone on it
