This sort of thing worries me, if that was me I just would not back down if I was in the right. I would honestly end up getting banged up over something like that I know I would. I came close a few years ago when a copper in the wrong wouldn't back down and spoke to me like I was a cnut.. in the end I just told him to take me in with my mrs shouting at me to leave it.. he did 'let me go' in the end.

I would fight something like that to the hills, surely if you get info from your phone provider with evidence that you weren't on the phone then it's got to be considered in court.

If people are genuinely getting shafted over stuff like this (and aren't guilty) then it's shocking... judges handing out even bigger fines etc for trying to stand your ground in court? wtf? I'd end up really loosing it, bad indeed.

ps do any of yous know if these cars are fitted with a recording system?either video or audio as it would be handy for my sake to let judge hear the pish they were talking!about seeing me on fone.then with maybe the white i-pod then checking logs etc and saying maybe i was playing with it.

im going to try and get a statment for the phone tomo but as its pay as you go and unregistered to anyone i doubt il get one.
plus its got a missed call which the police saw.i pointed out in the car that had i been on the fone it would have been to this person.
but theve written the time of the incident at the time of the missed call so all they will say is i picked they fone up i reckon.
also theres a law stating they can say i wasnt in complete control/fully concentrating on driving so i recon i will get shafted regadless.
i only pray i find their home adress to add them to my x-mas card list.
