Default advice please on police/law around advisory notice - SORTED!

Right sorry to rant but im livid at the minute.

Just went out to check the car as i always do before i lock up and theres a Police advisory notice on my car. Now to cut a long story short i live in a quiet terraced street in Crewe which is really narrow and if you park cars fully on the road theres no way a car could get through let alone an emergency vehicle. My side of the street is completely straight right the way up from top to bottom the opposite side of the street is the same apart from a section that comes out around a tree, without that there though bothe sides would be dead straight. Ok ive lived here nearly 7 years and parked my car in the same place every night.

Anyway it reads "14/7/08 time 19:40 Location etc VW Golf Reg DA57 ~~~ this vehicle is parked in contravention of regulations relating to : Parking on a footpath.

NOTES: (hand written by the plod) further action will be taken if not moved

This makes it an offence for which, on another occasion proceedings may be taken against you by way of fixed penalty notice or summons

On this occasion your vehicle details have been noted but NO action has been taken. please refrain from leaving your vehicle in such circumstances in the future as you may then face prosecution. THANK YOU FOR YOUR CO-OPERATION (talk about front!!!!)

Signed: Plod and badge number etc.

where do i stand with this guys??? gutless twat didnt bother knocking on my door and when i noticed it i went straight round to the plod shop to voice my opinions but they were shut

Im shocked, angry, livid, fuming and sick. Theres other cars with them too, honestly dont believe it to be honest.

Im going in work late tomorrow as i need to get this off my chest with them bastards in the morning andd i want PC4952 to talk to me about this bollocks.

Can they do this? where do i stand ?

To be honest.... im pretty sure theres bugger all you can do!

Are there any road signs saying you cant park there?

legally there has to be something to state the fact in the first place!

Absolutely nothing at all anywhere Maria, Cant tell you how i feel at the minute,ive had a car outside on the path for nealry 7 years. Im concious enough when i park to ensure a car can get through but i always also allow enough room should a lady with a double buggy want to get through.

When you go to the station tomorrow, ask them where it states you can or shouldnt park there.

If things have changed and there is a new 'rule' that you shouldnt be able to park there, then they would ofhad to of made you aware of pending changes at least 7 days before they come into play!

pics tomorrow if needed as its dark now. Its a blcck paved pavement thats been here as long as the house probably!!! The street is so narrow that if both sides of the street parked their cars fully on the road a car WOULD NOT get through. All my side park half on the road half on the path as we have to. Thing is last time i parked it on the road i got my rear light smashed in which cost ME to replace not my company even though its a company car.

If your road is that bad then you'd need to get a cummunity meeting set up with your local council to come to some sort of sollution...or this copper will keep pulling you up for it when ever he doesnt get his end wet prior to starting his shift

So there needs to be a sign there saying don't park on the pavement? Dont be daft!

You're not supposed to park on the pavement - it's for pedestrians!

If the road is narrow & by you parking your car there it causes an obstruction then as stated above you & the community need to get something sorted out, sometimes the old bill can't seem to use their common sense mate.

Thanks for taking the time to do that!!!! The orange mk2 golf in the pic on this is roughly where my opposite neighbours would be so if i parked mine fully on the road, visualise the gap using that picture of a new mk5 golf fully on the road on the opposite side.

What a load of bucking follocks IMO.

Mart Take some pictures in the day light of what happens if the car is park on the road, then with it parked half and half.

Then just continue doing as you have been, if you get called into court with every other person down the street then show the evidence and then ask when they are going to build you a car park. Also if you park on the road emergancy services would not be able to get down the road if they needed to which could in danger peoples lives.

yeah but why now after nearly 7 years of residence? shouldnt they be out stopping people with knives rather than putting stupid yellow notices on cars?

I'll tell you how anal it is, the opposite side of the road is empty, and before anybody says move your car off the kerb to the road, no i wont as the kink on the other side would bring traffic coming down the street straight towards my car as it will be almost directly in line with the traffic.

Sorry to keep going on but im fuming.

Lmao at stopping people with Knives, The majority of Crewe coppers are fannys mate wont come out if theres any trouble. I have actually seen them drive past an incident 3 times waiting for it to die down before they properly arrived at the sene, in that time someone could have been stabbed because they did fook all.

i do. as most of us would.and normally mr plod wouldnt bother you.
unless somebody has complained???.then mr plod would have to act on it.
becarefull what you say in the police station,as legally you havnt a leg to stand on.

I feel like leaving a small note stuck to the inside of my windscreen for PC4952 to read but feel that may get me in a bit of trouble. Those who know me will know i dont get wound up or angry but this has really really got to me.

Some councils have by-laws expressly forbidding it, others encourage it.

The Highway Code is just that - a code of conduct. It is not legally enforcable in itself, although of course a lot of what it states does come under the various Acts.

Any driver can be fined for causing unnecessary or wilful obstruction, and this is the penalty motorists can face for parking on the footpath or verge.

There's a full list of all the codes used, by parking wardens, for parking contraventions, here:

If you park on the pavement (other than in an approved zone), your parking ticket will show contravention code 62. (There's usually a suffix added to that code. e.g. 62/2 indicates that two wheels were on the footpath).

hes only advising you not to park on the pavement, which is an offence,,,,he could have reported it so think yourself lucky......

the answer, dont park illegally, then he cant do anything about it.



people get done for this sort of thing all the time, its not one rule for you, another for everyone else.....


we all do things illegal, be it speeding, parking etc, but its a known risk, if you get caught, accept it, dont cry about it....

you were illegally parked imo

it's only illegal to park on the pavement if the vehicle is 'causing an obstruction, or forcing pedestrians to walk in the road'

sell your car, or move house, or buy a moped. Outside where i live the payments are proper ones, id say 2.6m wide or move, if you park with a wheel on the pavement and one on the road, expect a ticket.

another thought, park on a set of bricks everynight, then i think legally your not parked on the pavement, the bricks are.

Trouble is Maria some of the 12 year old chavs in Crewe have 10 kids so imagine a the size of that buggy? and i can see Marts car causing an obstruction if on the pavement.

How im reading all this is, its not illegal to park on a pavement, but its illegal to cause an obstruction. Bit like hookers...you can shag em but you cant pick em up, either way the police will do you for sommot

i've talked to coppers in both middlewich and stoke on trent (so close enough to crewe) when i have been parked with all 4 wheels on the pavement. the first time, outside the skate park opposite the kings lock in middlewich if you know it i asked wether it was a problem and the copper looked and said no not atall as a wheel chair can easily get past.
second time i never mentioned it and nor did he.
just sounds like a coont of a copper if you ask me.

There has to be a 'visible' sign instructing that it is against council regs to park there, that can vary from a yellow line on the road, to signs of lamp posts to plaques on walls!!

i also think, if there was an accident outside your house, and you were parked on the pavement, things could get tricky....

I used to live down a very narrow street, terraced houses both sides, so no one had off road parking.

we all parked half off and half on the pavement and yeah ok youd get the occasional div that wouldnt understand, but the emergency services did have to be bloody careful if they ever came down!
