Employment Law Question?(do I have to serve my notice?)

Default Employment Law Question?(do I have to serve my notice?)

Hi all, I'm due to start with my new Fire Brigade on 14 May, but I have a problem, My old brigade that I am transfering from says I have to serve 4 weeks notice, and there's a course that I have to do before I can transfer that's on the 26 April.If I hand my notice in now, my course gets cancelled. So this would only give me 2 weeks to give my notice.

Do I have to serve my full notice?

I've tried to wangle it but it's a no go, If I hand my notice in on the 14 April then I wont be on this course, and this course means hopefully a £400 a month pay increase in my new brigade!

What if I take leave for 2 weeks from my old brigade whilst I'm in my new brigade Only thing is I wont have officially left them yet? Or what if I just say I'm giving 2 weeks notice then I'm off? They can't physically force me to come to work, and if I get a Disciplinary, so what, I've left anyway. It's not exactly the Army!

Anyone know anything about Employment Law?

Could you not explain the situation to your new employers and see if they can accomodate your course and notice period, so that you're not burning any bridges?

Where you moving to the Newbury one or you found some where else i know you were talking about the newbury one as it was closer ect

As mike said speak to your current boss and see if he will look at the situation for you. Or maybe come to an agreement about you taking whatever leave you have ?

I know people in companys i have worked for have been able to come to an arrangment as the boss's discretion.

Only thing is Mike, There's 16 of us starting on that day, and they won't be taking a new intake of new recruits/service transfers for a long time after that date, maybe even a year. If I can take this course qualification with me, than I'll be soooooo much better off, and also not have to worry about alot of extra training over the next 3 years in my new Brigade.

I need to do this course, but I also must leave on the 14 May.

AAAAAAAAAARRRRRRRRRRRRRRRGGGGGGGGGGGHHHHHHHHHH!


Alan, nah, it's away from Newbury, quite a way away actually, but so much scope for promotion and career.

If I were you, I would consult an employment solicitor to find out exactly where you stand. It may cost you a few quid, but well worth knowing exactly what you can and cannot do. Don’t you belong to a union? Can’t you ask them?

Pop into the Citizens Advice...free and might be quite useful...saves you forking out for a solicitors advice if you don't need it

Firstly, how long have you worked for the company?

Secondly, how much notice does it state you need to give in your contract with them?

And finally are either company's connected in any way? Have you had an Offer of employment from the new company in writing and a contract?

4 years

4 weeks

They're not connected, most brigades are seperate now, I'm awaiting my new contract but got allready got a "Conditional offer of employment"

I'm tempted to just do the course and say the day after that I'm leaving in 2 weeks, what can they do? Fair enough, I'll of broken the terms of my contract, but there's hundreds of other Firefighters there, so it's not like I'm leaving some little 5 person company in the lurch with a huge workload.

if you have any outstanding holiday then it sometimes can be used in conjunction, has in the past 3 places i have worked for.
or just hand your notice in and fone in sick
