Default Pictures, copyright and Performance Ford....

As some of you may remember, I posted some pictures taken from a Motorshow in Oslo here, in the end of april.
The pictures was of the Norwegian WRC-Escort, which you may have seen in the Performance Ford magazine, or at Donington last weekend. The pictures I took was the first official pictures from the car on the internet, and without them many of you maybe would'nt be aware of the car. My problem is that the Performance Ford magazine hase stolen and used this pictures in their august-edition, page 130, to advertise for the report of this car in their september-edition, all without asking me or contacting me in any way, or giving me any credit.

In Norway we have copyright on all pictures, even if the are produced for the internet.

I am asking you for your honest opinion about Performance Ford's method in this matter, is this how they behave ?
I have tried to send them email, but they don't reply.

Need advice for what to do, and behave in this matter. All advice is appreciated

in norway its your rules, i dont know how it would stand over here as we dont know what your rules are!?!? hence, the pictures were taken and used with nowing about your copyright laws.

the PF boys are on here anyway, you may get an answer.

I`am sure this can be sorted out , without resorting to any legal action. The Performance Ford team are good people and their must be a explanation for there actions.

Sorry but taking pictures off the net, to promote a future feature in a profit making magazine, without permission from the originator is wrong. If they were used on another forum fine, but to print them in a magazine obviously promoting the next issue is a big no,no.

Hopefully PF will realise this and send out there sinceres

I think you are going over the top a bit as they are only a few pics. and we were all going to see it your pics or theres! Maybe you should of sold them to the sun 1st

copyright ... is copyright no mater where it is .. im sure if you used the coke or nike tradenames or logo's you would soon have a letter from said company...

I always say "It's not the principle, it's the money".

However, I think getting them to acknowledge you as the photographer in the next available issue, and a tears free subscription should sort it.

they should have at least put pictures coutesy of .........
instead they have taken credit for something that isnt theres to take credit for IMO.
wingdude if i was you id just put some sort of markings on your pics so this doesnt happen again

I obviously can't speak on behalf of PF, but I'm sure they weren't intentionally meaning to cause you upset. They obviously wanted to promote the feature, and maybe didn't have their own pictures at the time of going to press. I'm also sure that if they knew you were the owner they would've sought your permission first/credited the photo to you.

They're a good bunch of guys, and I'm sure they'll try to make amends.

What are you after as a result of this, would a credit in a subsequent issue be satisfactory?

But surely someone else could have copyed and posted your Pic's on another forum ect...
Therefor Performance Ford would not know who to contact anyway because your pictures werent marked?

Wingdude: When we were trying to locate some photographs of the the car for our next month page, we did get the pics off of one of the members of this site.
I personally spent the best part of a day looking for the original posting of the pics but was unable to do so, so I asked another member that had them saved on his computer.
The pictures were not marked as being copyrighted, nor did we have any means of contacting the person that took them.
The fact that they have already been printed without your permission is something that we can not change, only apologise for if this is indeed the case.
If you send me your name and details, I'll ensure that you are acredited with having supplied the pictures in the next issue.
We do give credit for any photography we use, but as we get sent so many pictures from so many sources on a daily basis this is not always possible.

It does not really matter, if you don't know who the author is, then you are not allowed to use the pictures at all!! If they are posted on the internet does not matter. What PF has done here is clearly very unethical for a magazine IMO, as this car is from Norway and the pics where taken at a Norwegian motorshow you don't have to be a rocketscientist to figure out who has taken the pictures, the car scene in Norway is not that big and you would probably get an answer the same day that you post something in a norwegian internet forum. If you want any info regarding the Norwegian Ford scene, post it on the forum at www.cosworth.no and you will get the info needed pretty rapidly...

In Norway this is not accepted at all!! And if a Norwegian magazine/newspaper where caught in doing something like this they would have to pay, but of course it depends on how far the photographer would take it, but he would win the case.

nike are copyrighted cos they are a proper company and have gone through the proper proceedings,a picture cant be copyrighted just because said person took it and didnt give his permission,theres paperwork and such to be sorted out,you cant just slap copywright under neath it

Nick has said his peace, which IMO is fair

I don't give a toss about this copyright lark, its just the principle, they wouldn't like it if it was the otherway round. In fact I remember them specifically telling people NOT to post times of RS turbo thrashes as they wanted the "news to break" in the magazine.

a picture cant be copyrighted just because said person took it and didnt give his permission,theres paperwork and such to be sorted out,you cant just slap copywright under neath it
Actually, you are wrong.......and trademarks are a little different to the copyright of something.

And as Nick has now posted, maybe it should be left for Wingdude and PF to sort out between themselves?
