excessive avoidable smoke is a failure, but they should have done an emmissions test or refused to test on the grounds of the engine being unfit to test.

stick some Forte in it and send it back.

if its oil burning then chuck a can of low-smoke in and get it mot'd and chuck it through the auction- good stuff that low-smoke is!
