Default advice needed about garage warranty work

hi need some help,feeling shafted!
cut a long story short bought e90 320d m sport from duthies citreon in Montrose with a years warranty,
they put new front brakes on not long after I bought it and little while later 1 front shock then the other front shock,
all good I thought.but..

within couple months shocks leaking and discs cracking,

they picked this up at mot as advisory,

now after them never getting back to me about it they want car to take photos,but they know problem,

also was standard shocks they used not shorter m sport ones,

they not accepting its shit products they using.

so told them to day to take car back and give me my money back as my 24yr old cossie drives better,

any suggestions as speaking to the main man tomorrow unless he avoids it,

Thing is with used car warranties is that they aren't usually supplied by the dealer. They are normally provided via an outside company such as auto trust etc. For some replacement parts such as injectors and as you have mentioned shocks these are supplied directly from the warranty company and generally the cheapest chap they can get hold of so I would imagine you would have to contact the warranty company and fight this out with them as in my eyes this is a parts warranty sort of issue and as the dealer technically hasn't supplied the part they are in no place to honour it. However the brake disc issue would be the dealers responsibility as these would never have been replaced nor been covered by any warranty as such they would then be dealer replaced parts and they are responsible for supplying parts not fit for purpose etc.

For starters i own my own garage ,

If they fot the wrong shockers then they have to replace them for the correct ones for the car, regarding warrenty who ever they got them off will replace them foc under supply warrenty, so it shouldnt cost them any thing if they had fit the correct ones in the first place

As for the discs they are wear and tear so not a leg to stand on

Also the seller is responsible for the car to be fit for purpose for 12 month , dealers sell cars with warrenty so the buyer hopefully leaves them alone and deals direct with the warrenty firm

they supplied/sourced and fitted the parts,everything less than 6 months old,
one shock is a boge and the other a kyb,
they said they will do the warranty if needed when I bought it,
just felt the discs should lasted longer,
horrible to drive to,

so really they will probably keep me hanging till I give up,

the service manager argued that they gave the registration and they shocks are correct,
ive checked the part numbers and they are the wrong ones,

Id tell them out right that regardless of whetger they gave reg number or not they are wrong type for car and your fully prepared to go all the way to court

Also have you taken finance out as you can complain to the finance company who will come down on them like a ton of bricks , as they technically own the car and can handle this for you!

seek free advice from citizens advice bureau, speak to trading standards they will advise you accordingly.

mention citizens advice and trading standards, you'll soon have your money back.


its fair to say that the motor trade doesnt do itself many favours in instances like this, and i work within the trade.

suspension needs to be changed in axle sets.....

health and safety etc

with two different types of shock fitted it's dangerous to drive as they aren't matched, if they didn't pick that up and fail it on the mot then thats another thing to bollock them on

Unfortunately none matching shock absorbers are not an mot failure. As long as they are fit correctly , operate correctly and aren't damaged or leaking you can fit a 15 year old second hand one to one side and a brand new cheap Chinese one to the other.

as said above matching shocks is not an MOT failure, shocks are checked for condition and as long as they're serviceable at the time then it's a pass

Don't see how cracked discs soon after buying a car can be dismissed as "wear and tear" as very likely they were in that condition when it was bought.

They're taking car back in to fix and giving me a car till its fixed,
Said about the non m sport shocks so will see what they get replaced with,
They replaced discs not long after I bought car so discs maybe 6 month old,
The shocks were leaking when they mot'd it,was an advisory
